【摘要】：自2011年8月《最高人民法院关于适用中华人民共和国婚姻法若干问题的解释(三)》(下文简称解释(三))生效以来,出现了一系列的社会和法律问题。本文以此为关注点,探讨了离婚过程中关于财产分割的若干重大问题。解释(三)共有19款条文,制定的原因包括房价高涨,离婚率上升,以及年轻一代中对待婚姻的社会和道德观念不断弱化,这些原因也会在讨论中有所涉及。各方对解释(三)抱有不同观点,本文兼采各观点并对其可取之处进行分析。此外,本文还会从法律和社会层面出发,将解释(三)的原则与2001年婚姻法修正案进行比较,揭示出解释(三)的不足之处。作者以西方视角对解释(三)进行分析并得出结论,强调中国立法者必须为中国的发展前进而考虑。本文由五章构成。第一章介绍了中国人对待婚姻的普遍价值观念,包括了中国家庭的传统规范。该章有助于读者更好地理解解释(三)对社会所造成的影响。第二章介绍了婚姻法自1950年到现在的沿革,从不同的时代背景及法律的影响和缺点入手,对1950年、1980年和2001年的婚姻法进行了详细的解读。第三章聚焦于解释(三)本身,介绍了中国的司法解释概念及其法律效力,详细分析了解释(三)的主要条款,并指出其积极和消极之处。第四章为本文主要章节,该章分析了解释(三]若不修正,它将对中国产生什么样的影响,同时还提供了相应问题的解决方案。第五章为结论部分。由于作者为加拿大出生的华人,现在正在中国学习法律。本文是以西方角度审视解释(三),得出解释(三)必须进行修正的结论并对其进行了分析。
[Abstract]:Since August 2011, the Supreme people's Court on the application of the Marriage Law of the people's Republic of China's interpretation of certain issues (3) > (hereinafter referred to as interpretation (San Wei)) came into effect. There are a series of social and legal issues. This paper focuses on the divorce process of several major issues about the division of property. (3) there are 19 articles. The reasons for this include soaring house prices, rising divorce rates and weakening social and moral attitudes towards marriage among the younger generation. These reasons will also be involved in the discussion. The parties have different views on interpretation (3), this paper adopts each point of view and analyzes its merits. In addition, this paper will proceed from the legal and social aspects. By comparing the principle of interpretation (3) with the amendment of 2001 Marriage Law, the author reveals the inadequacies of interpretation (3). The author makes an analysis of interpretation (3) from the perspective of the West and draws a conclusion. He stressed that Chinese legislators must consider China's development. This paper consists of five chapters. The first chapter introduces the universal values of Chinese marriage. Including the traditional norms of the Chinese family, this chapter helps readers to better understand the impact of explanation (III) on society. The second chapter introduces the evolution of Marriage Law from 1950 to now, starting with the different background of the times and the influence and shortcomings of the law, 1950. The marriage law of 1980 and 2001 is interpreted in detail. The third chapter focuses on interpretation (3) itself, introduces the concept and legal effect of judicial interpretation in China, analyzes in detail the main terms of interpretation (3), and points out its positive and negative points. Chapter 4th is the main chapter of this paper. This chapter analyzes the explanation (3) what kind of impact it will have on China if it is not revised, and also provides the corresponding solutions to the problems. Chapter 5th is the conclusion. Since the writer is a Canadian-born Chinese, he is now studying law in china. This article looks at the explanation from a western perspective (3). The conclusion that explanation (3) must be amended is obtained and analyzed.
