【摘要】：为何要在革命语境下对婚姻自由的法律表达进行阐释?这不仅是因为革命与革命语境下的法律表达有着深刻的逻辑互动,并且通过比较性的分析能够揭示出法律表达机制在革命的宏观语境和微观情势中不断变迁的痕迹。更深层次的原因在于通过叙述革命语境中法律话语的建构和变迁,揭示出特殊时期共产党人探索马克思法律思想中国化的逻辑脉象。共产党人对婚姻的治理是随着中国法制现代化进程而不断推进的,中国革命时期婚姻法制的变迁反映了共产党人革命政策的变化,也折射出马克思主义法律思想被运用于解决中国问题的艰难探索历程。本文以革命时期婚姻自由的法律表达为微观契入点,通过对结婚自由和离婚自由法律表达的分析,试图揭示出革命时期共产党人理解和实践马克思法律思想中国化所显现的独特精神和逻辑内涵。本文叙述婚姻自由法律表达的场域被确定在中国农村革命根据地,并且时间限定为1927年至1945年间,从中共在江西瑞金建立革命根据地开始到抗日战争胜利结束,选择这一区间的原因不仅在于这两个阶段有着明显的分期性特征,还在于由这种分期性特征能够引发革命者在制度和策略上的显著变更。这段时期婚姻自由的法律表达展现的是红色农村地区对共产党人法制实践的接受和反应,中共在红色农村地区宣扬和贯彻革命义理,运用特有的手段包括司法手段来推行革命动员中包含的普世价值理念,要想实现革命与民众之间的预期互动,其中要处理的问题显得尤为复杂,这是中国革命转向农村所带来的必然结果,也是革命场域被重新确立后共产党人必须正视的理论和实践难题。文章共分为四部分: 引论部分阐述了本文所要研究问题的缘起、研究意义及当前研究现状,并对关涉文章基调的关键词和语境进行了交代。第一部分揭示了五四新文化运动对中国革命根据地时期婚姻自由法律表达的智识导引,这是新民主主义婚姻自由法制实践的基本智识来源。第二部分叙述了革命作为本文探讨婚姻自由法律表达的语境,革命动员目标的达成是革命时期进行社会改革的基本诉求。第三部分是文章的重点,笔者在这一部分展开对革命根据地时期婚姻自由法律表达的叙述。该部分的第一个子部分从婚姻法制史的角度对共产党人在根据地时期的婚姻法制建设进行概述;第二个子部分以“意志”为关键语词对这一时期婚姻自由基本原则的确立轨迹进行揭示;第三个子部分阐释了根据时期结婚自由在彰显与隐约中被表达的逻辑线索;第四个子部分探讨了离婚自由在革命根据地时期的法律表达,叙述了共产党人在这一时期处理离婚问题的策略演变过程。结论部分对中国革命语境中法律变迁的逻辑脉象进行了揭示,基于马克思法律思想中国化进路对“中国革命现代性”与法律话语之间的逻辑互动进行了阐释,并认为把新民主主义革命时期婚姻自由的法律表达放置于马克思法律思想中国化的历史进程中考察深具理论和实践意义。
