婚姻家庭法视野下的儿童权利保护

【摘要】：儿童被视为社会的未来和希望。随着现代社会的飞速发展,儿童受到了越来越多的关注,但是儿童的权利往往容易被人们所忽视。在我国,儿童权利的保护长期处在学术关注的边缘,儿童的权利由于其自身的一些特点,和一般人的权利存在着很大的不同。因此,有必要完善相应的立法来更好地保护儿童的合法权益。本文立足于婚姻家庭法,从研究我国儿童权利的基本理论入手,分析国内外儿童保护现状及不足,提出完善我国儿童权利法律保护的立法建议。添加了儿童最大利益原则,建立非婚生子女的认领制度,完善司法程序,完善监护和抚养制度,制定完善的亲权制度。以保证能及时和全面地保护儿童权利。
[Abstract]:Children are regarded as the future and hope of society. With the rapid development of modern society, children are paid more and more attention, but children's rights are often ignored by people. The protection of children's rights has been on the edge of academic attention for a long time. The rights of children are very different from those of ordinary people because of their own characteristics. It is necessary to improve the relevant legislation to better protect the legitimate rights and interests of children. This article based on the marriage and family law, from the study of the basic theory of children's rights, analyzes the current situation and shortcomings of child protection at home and abroad. To improve the legal protection of children's rights legislative recommendations. Add the principle of the best interests of the child, establish the system of claim of children born out of wedlock, perfect the judicial process, improve the guardianship and maintenance system. Develop a complete parental authority system to ensure the timely and comprehensive protection of children's rights.
