【摘要】：张家川自治县回族起源于伊斯兰教,其风俗习惯均带有伊斯兰文化的影子,同时又在发展过程中受到中国传统文化的熏陶,张家川回族最终形成了自己独特的风俗习惯。婚姻习惯法作为张家川回族习惯法的重要组成部分,具有重要的研究价值。由于历史原因,张家川回族婚姻习惯法中一些积极向上的内容不为多数人所知,甚至还有许多问题引起人们的误解。在经济、政治、文化等快速发展的今天,如何客观地了解和评价张家川回族婚姻习惯法,如何汲取回族婚姻习惯法中的积极内容,如何对其与国家制定法的冲突进行调适,这些问题都关系到地区稳定和国家的整体发展。文章选取张家川回族文化中的婚姻习惯法作为研究主题,从构建社会主义法治和谐社会的目标出发,通过文献研究法、问卷调查法以及案例分析法,首先对张家川回族婚姻习惯法的形成和发展作简要介绍,重点阐述了婚姻习惯法的主要内容；其次以张家川回族婚姻习惯法和我国《婚姻法》的关系为切入点,重点对二者的冲突进行分析并提出调适建议;最后进一步探讨张家川回族婚姻习惯法在实现依法治国及促进文化传承方面的存在价值。笔者希望本文能够有助于实现张家川回族婚姻习惯法和我国《婚姻法》相辅相成的和谐模式,进而为全面实行依法治国、推动少数民族地区和国家整体发展起到一点帮助。
[Abstract]:The Hui people in Zhangjiachuan Autonomous County originated from Islam, and their customs and habits were influenced by the traditional Chinese culture in the course of their development. As an important part of the customary law of Zhangjiachuan Hui nationality, the marriage customary law has important research value. Some of the positive aspects of the customary law on marriage of the Hui nationality in Zhangjiachuan are not known to most people, and there are even many problems that have caused misunderstanding. Today, with the rapid development of economy, politics, culture and so on, How to objectively understand and evaluate the customary law of marriage of the Hui nationality in Zhangjiachuan, how to absorb the positive content of the customary law of marriage of the Hui nationality, and how to adjust the conflict between the customary law of the Hui nationality and the law made by the state? These problems are related to the regional stability and the overall development of the country. This paper selects the customary law of marriage in the culture of Zhangjiachuan Hui as the research theme, starting from the goal of building a harmonious socialist society ruled by law, through the literature research method. First of all, it briefly introduces the formation and development of the customary law of marriage of the Hui nationality in Zhangjiachuan, focusing on the main contents of the customary law of marriage. Secondly, based on the relationship between the customary law of marriage of the Hui nationality in Zhangjiachuan and the Marriage Law of our country, the author analyzes the conflict between them and puts forward some suggestions for adjustment. Finally, the author further discusses the existence value of Zhangjiachuan Hui Marriage customary Law in the realization of governing the country according to law and promoting cultural inheritance. The author hopes that this article can be helpful to the realization of Zhangjiachuan Hui Marriage customary Law and our country Marriage Law. A mutually reinforcing model of harmony, And then for the full implementation of the rule of law, to promote the overall development of minority areas and countries play a little help.
