论我国社区照管的法治理念与制度设计

【摘要】：21世纪的中国在各个领域都处于高速发展的阶段,然而,在其经济高速发展的同时,人口老龄化的发展也尤为迅速。面对我国已步入老龄化社会的现状,传统的赡养和监护制度已经无法全面应对因4-2-1小家庭结构模式和空巢老人出现等现象所带来的一系列问题,很大一部分老年人的合法权益因此处于立法保护的空白状态,“社区照管”的理念及其制度安排正是在这一环境下萌芽的,迎合了我国养老制度更生的需要。立足于我国社区照管制度的理念、价值追求以及制度设计,探讨通过该制度实现对英国社区照顾制度与德国照管制度的借鉴与有机结合,构建具有中国特色的社区照管养老制度。比较英国社区照顾与德国照管制度,二者各有利弊。一方面,英国社区照顾制度立足于养老目标的实现,但却忽略老年人的意思能力;另一方面,德国照管法充分体现了对老年人意思自治的尊重,但在我国当前社会背景下却缺乏制度实现的载体,若生搬硬套,难免会面临水土不服的窘况。因此,我国社区照管制度应在借鉴英国社区照管形式的基础上,融合德国照管法尊重老年人自我意识表示的制度设计,充分发挥我国社区养老的优势,探讨构建以社区为依托的照管制度,为我国老年人养老问题提供一条解决之路。通过运用价值分析、比较分析等方法对我国老年人社区照管的制度设计进行了系统的研究。首先,运用概念分析法,对社区照管概念进行概述。其次,运用价值分析的方法,从我国现有制度不足之处进行探讨。再次,运用比较分析的方法和文献研究法,分析国外立法的成功经验,并以此为据提出可借鉴的制度内容。笔者希望通过本文的研究,能丰富我国相关理论,完善相关法律配套制度,从而真正保护我国老年人养老的合法权益。
[Abstract]:In 21th century, China was in the stage of rapid development in all fields. However, with the rapid development of its economy, the aging population is also developing rapidly. The traditional system of maintenance and guardianship has been unable to fully cope with a series of problems brought about by the phenomenon of the 4-2-1 family structure and the emergence of empty nesters. As a result, the legal rights and interests of a large part of the elderly are in a blank state of legislative protection. It is in this context that the concept of "community care" and its institutional arrangements have sprouted. Based on the concept, value pursuit and system design of the community care system in China, this paper discusses the reference and organic combination of the British community care system and the German care system through this system, which meets the needs of the rehabilitation of the old-age system in our country, based on the concept, value pursuit and system design of the community care system in China. Comparing the British community care system with the German care system, there are both advantages and disadvantages. On the one hand, the British community care system is based on the realization of the goal of the aged, but neglects the meaning ability of the elderly. On the other hand, the German care law fully embodies the respect for the autonomy of the elderly, but in the current social background of our country, there is no carrier for the realization of the system. On the basis of drawing lessons from the form of British community care, the community care system of our country should be integrated with the design of German care law which respects the self-consciousness of the elderly, so as to give full play to the advantages of the community old-age care in our country. This paper discusses the construction of community based care system, which provides a way to solve the problem of the aged in China. The system design of community care for the elderly in China is systematically studied by means of comparative analysis and other methods. Firstly, the concept of community care is summarized by means of conceptual analysis. Secondly, the method of value analysis is used to analyze the concept of community care. Thirdly, using the method of comparative analysis and literature research, the author analyzes the successful experience of foreign legislation, and puts forward the system contents which can be used for reference. It can enrich the relevant theories of our country, perfect the supporting system of relevant laws, so as to protect the legal rights and interests of the aged in our country.
