“家庭伴侣结合”位阶概念体系厘定与规范

【摘要】：在理论上,国内外鲜有法学研究者发现、梳理"家庭伴侣结合"概念位阶体系,多数研究局限在"家庭伴侣结合"下属各级概念及相互关系上,均是"点—点"式研究,尚未"由点及面""由面及体"。我们尝试梳理出各国事实状态上"家庭伴侣结合"概念位阶体系的四种典型类型。我国未来家庭伴侣结合发展的最适合路径是第一种类型。我国现阶段"类婚姻"规范入法的时机尚不成熟,但这不妨碍在理论上先做客观、科学的梳理、探索和储备,与世界上该类研究做有益的互动。首次尝试以"类婚姻"这一称谓来框定相关法律关系。对于类婚姻配偶关系的规范世界上一般有五种模式,包括不保护、扩张婚姻概念、订立合法契约、法律拟制和创设新制度,有时两种模式也会出现交叉并用情况。我国对于"家庭伴侣结合"的规范路径可以从婚姻拟制起步,逐步形成新型"家庭伴侣结合"的专门性法律规范。
[Abstract]:In theory, few legal researchers at home and abroad find that combing the conceptual hierarchy system of "family partner union", most of the studies are confined to the concept of "family partner union" at all levels and their relationships, and are all "point-point" studies. We try to sort out four typical types of the conceptual hierarchy system of "family partner union" in the actual state of each country. The most suitable path for the future development of family partner union in China is the first. At the present stage in China, the time is not ripe for the entry of the norm of "like marriage". But this does not prevent us from making objective and scientific combing, exploring and reserving in theory. It is the first time to use the term "similar marriage" to frame the relevant legal relationship. There are generally five models in the world for regulating marital relationships, including unprotected, expanding the concept of marriage. The conclusion of legal contract, the establishment of legal system and the creation of new system, sometimes the two models will also be crossed and used. The normative path of "domestic partner union" in our country can start from the marriage fictitious system. Gradually form a new type of "domestic partnership" specialized legal norms.
