我国未成年人监护制度社会化问题研究

【摘要】： 未成年人监护制度是一项非常重要的法律制度。该制度目的在于保护无民事行为能力或限制民事行为能力的未成年人的人身、财产和其他合法权益,保障未成年人健康成长,维护社会正常运行。我国未成年人监护制度发展较晚,虽然初步形成了一定的内容涵量,但是由于种种原因,我国现行的未成年人监护制度从指导思想到具体制度内容均存在不少立法缺陷。随着社会的变革,婚姻、家庭与监护关系日趋复杂,更日益凸显出我国未成年人监护制度滞后于中国社会发展的客观现实需求。未成年人监护制度的改革亟待进行。立足于未成年人权益保障,本文从完善我国未成年人监护制度的目的出发,在梳理了我国现有未成年人监护制度的内容和缺陷后,返璞归真,运用社会学原理,分析了未成年人监护与未成年人社会化的关系,总结了未成年人监护的社会学意义,确证了国家在未成年人监护中所负有的不可推卸的责任;进而在回顾未成年人监护制度历史样态的基础上,展望了这项制度的未来走向,指出未成年人监护的社会化将是未成年人监护制度发展的趋势。基于此,在分析我国现行社会和法律条件的基础上,同时借鉴国外的有益做法,对我国未成年人监护制度的发展提出了意见和建议。
[Abstract]:The system of guardianship of minors is a very important legal system. The purpose of the system is to protect the persons, property and other legitimate rights and interests of minors who have no capacity for civil conduct or to limit their capacity for civil conduct, so as to ensure the healthy growth of minors. To maintain the normal operation of the society. The system of guardianship of minors in our country has developed relatively late, although it has initially formed a certain amount of content, but for various reasons, There are many legislative defects in the current system of guardianship of minors in China, from the guiding ideology to the content of the specific system. With the change of society, marriage, family and guardianship relations are becoming more and more complicated. It is more and more obvious that the juvenile guardianship system of our country lags behind the objective realistic demand of the development of Chinese society, and the reform of the juvenile guardianship system needs to be carried out urgently. Based on the protection of the rights and interests of minors, this paper proceeds from the purpose of perfecting the guardianship system of minors in our country, after combing the contents and defects of the existing guardianship system of minors in our country, returns to nature and applies the principle of sociology. This paper analyzes the relationship between the custody of minors and the socialization of minors, summarizes the sociological significance of the guardianship of minors, and confirms the unshirkable responsibility of the state in the custody of minors; Then, on the basis of reviewing the history of the guardianship system of minors, this paper looks forward to the future trend of this system, and points out that the socialization of the guardianship of minors will be the trend of the development of the guardianship system of minors. On the basis of analyzing the current social and legal conditions of our country and drawing lessons from the beneficial practices of foreign countries, this paper puts forward some opinions and suggestions on the development of the guardianship system of minors in our country.
