【摘要】：妇女问题历来都是社会的热点问题之一,也是任何社会,任何国家要进行改革和发展所必须关注和解决的重大问题,而妇女的法律地位,则是衡量社会文明程度的重要标志。综观古罗马历史,妇女在婚姻家庭法中的地位发生了重大的变化。本文论述和分析妇女在罗马婚姻家庭法中地位的变迁情况及其特点,是在吸收和借鉴前人研究成果的基础上,通过自己的学习和思考后写成的。本文通过考察罗马国家制度和家庭制度的特点,探讨罗马婚姻家庭法立法的历史背景及妇女在其中的地位变迁状况,并最终分析了这一变迁的特点。在早期的罗马,无论是在国家制度还是在家庭制度中,男性都处于绝对的统治地位,这就决定了罗马的婚姻家庭事务必然会服从于男性统治的需要,而妇女只能处处依附于男性,她们在婚姻关系,家庭关系中的地位十分低下。布匿战争后,罗马社会进入到了转型时期,政治,经济发生了大变革,男性在国家制度,家庭制度中的权力受到削弱。这就有利地推动了政府在妇女问题立法上的思考和决策,妇女的法律地位有了很大的改善和提高。妇女在婚姻关系中有了一定的自主权:在家庭关系中,妇女的人身依附关系逐渐松弛并且取得了一定相对独立的财产权。从罗马婚姻家庭法的法律规定中,我们可以看出妇女地位的变迁具有以下四个特点:男女趋于平等;妇女逐渐从父权制家庭中解放出来,从而开始了从身份到契约,从家庭本位到个人本位的转变:妇女有了独立的人格,这促进了罗马夫妻一体主义向夫妻分别主义的转变;妇女取得了一定的婚姻自主权。
[Abstract]:The issue of women has always been one of the hotspots of society, and it is also a major problem that any society, any country must pay attention to and resolve in order to carry out reform and development, and the legal status of women, It is an important symbol to measure the degree of social civilization. In the history of ancient Rome, the status of women in the law of marriage and family has changed greatly. This paper discusses and analyzes the changing status and characteristics of women in the Roman law of marriage and family. It is written after learning and thinking on the basis of absorbing and drawing lessons from previous studies. By investigating the characteristics of Roman national system and family system, this paper discusses the historical background of Roman marriage and family law legislation and the changing status of women in it, and finally analyzes the characteristics of this change. Both in the state system and in the family system, men are in absolute dominance, which determines that Roman marriage and family affairs are bound to serve the needs of male domination, and that women can only depend on men everywhere. Their status in marriage and family relations is very low. After the Punic War, Roman society entered a period of transition, political and economic changes took place, and the power of men in the national system and the family system was weakened. This helped to promote the government's thinking and decision-making on women's issues legislation. Women's legal status has been greatly improved and raised. Women have certain autonomy in marriage: in family relations, women's personal attachment gradually relaxes and they obtain certain independent property rights. From the legal provisions of the Roman Marriage and Family Law, we can see that the change of the status of women has the following four characteristics: men and women tend to be equal, women are gradually liberated from patriarchal families, thus starting from identity to contract, The transformation from family standard to individual standard: women had independent personality, which promoted the transformation of Roman husband and wife integralism to husband and wife separatism, and women obtained certain marital autonomy.
