德国家事诉讼中子女利益保护人制度及其启示

【摘要】：20世纪80年代,德国学术界掀起了子女利益保护研究的热潮,家事案件确保子女最佳利益的理念被社会认同。在相关理论研究的推动下,德国建立了子女程序保护人制度,以保障家事诉讼中子女权益不会陷入危险境地。修改家事诉讼法时将程序保护人名称改为程序辅佐人,并进一步明确了程序辅佐人的法律地位、权限和任务,从立法上强化了子女利益保护人活动的正当性。我国家事诉讼中子女利益的保护明显不足,应借鉴德国的法律经验,完善我国现有的婚姻法立法或司法解释,确保家事诉讼中子女利益不受侵害。
[Abstract]:In the 1980s, the German academic circles set off an upsurge of research on the protection of children's interests, and the idea of ensuring the best interests of children in family cases was recognized by society. Under the impetus of relevant theoretical research, Germany established the system of child procedural protectors. In order to protect the rights and interests of children in family proceedings from being in danger. When amending the Family procedure Law, the name of the procedural protector was changed to the procedural helper, and the legal status, authority and task of the procedural assistant were further clarified. It strengthens the legitimacy of the activities of children's interests protectors in legislation. The protection of children's interests in family litigation in China is obviously inadequate. We should learn from the legal experience of Germany and perfect the existing legislation or judicial interpretation of our country's marriage law. To ensure that children's interests are not infringed upon in family proceedings.
