【摘要】：为了更好地在实践中落实我国《婚姻法》及相关法律,最高人民法院在2011年通过了《关于适用中华人民共和国婚姻法若干问题的解释(三)》。以第七条规定为代表,规定了关于房产“由谁出资,归谁所有”的看似公平的法律条文。该司法解释一出,引发了社会上关于房产应该如何归属的讨论,在准婚族,甚至已婚多年的夫妇中出现了房产加名的现象。这种新生的怪现象造成了一系列的社会问题,如增加了房产部门和普通百姓的负担,影响夫妻和谐甚至引发离婚诉讼,一方通过加名短期内获取另一方大量财产等。《婚姻法解释(三)》的初衷是为了更好地保护私有财产的不可侵犯性,但其效果是失败的。中华民族有着崇尚家和万事兴的民族传统,婚姻家庭是我国社会生活的基础元素,良好的婚姻法律制度对于维护社会稳定和谐具有重大意义。我国婚姻法中曾规定了夫妻个人财产的转化规则,在很长的时间内其对我们的婚姻生活进行了有效的规制。这一规则在2001年被废除,但是其废除太过于草率,由此引发现在社会上诸如婚姻家庭不和谐、离婚率升高等一系列社会问题。本文通过对该规则的研究,设想将其重新纳入我国的婚姻法律体系,以解决当下社会存在的诸多问题。全文共分四个部分:第一部分为引子,通过案例提出问题,指出当前夫妻财产制度在指导人们的婚姻生活中所面临的问题,引出夫妻个人财产的转化规则。第二部分为转化规则的存续及原因分析。第三部分通过介绍国外有关的法定夫妻财产制度,并结合我国具体国情,分析转化规则在我国婚姻法体系中的合理性。第四部分为转化规则回归我国婚姻法的路径分析,提出夫妻个人财产的转化规则回归我国婚姻法的立法构想。希望笔者的研究能够对现存的婚姻家庭问题有所裨益,能够警醒我们在废除法律条文之前进行更为充分的论证和研讨。
[Abstract]:In order to better implement the Marriage Law and related laws in practice, the Supreme people's Court in 2011 adopted the interpretation of several issues concerning the Application of the Marriage Law of the people's Republic of China (3).Represented by Article 7, it provides seemingly fair legal provisions on who pays for the property and who owns it.The judicial explanation has triggered a social debate about how property should belong, and the phenomenon of adding names to property among quasi-married couples and even married couples for many years.This new phenomenon has created a series of social problems, such as increasing the burden on the real estate sector and ordinary people, affecting marital harmony and even triggering divorce proceedings.One party acquires a large amount of property of the other party in a short period of time by adding names. The intention of the Marriage Law interpretation (3) is to better protect the inviolability of private property, but its effect is unsuccessful.The Chinese nation has a tradition of advocating family and everything. Marriage and family are the basic elements of our social life. A good legal system of marriage is of great significance to maintain social stability and harmony.The law of marriage of our country has stipulated the transformation rule of husband and wife's personal property, which has carried on the effective regulation to our marriage life in a very long time.The rule was abolished in 2001, but it was too hasty, causing a series of social problems such as marital disharmony and high divorce rate.Based on the study of this rule, this paper proposes to bring it back into the legal system of marriage in our country in order to solve many problems existing in the lower society.This paper is divided into four parts: the first part is the introduction, through the case put forward questions, pointed out the current marital property system in the guidance of people's marital life faced problems, leading to the transformation of marital personal property rules.The second part is the existence and reason analysis of the transformation rules.The third part analyzes the rationality of the transformation rules in the marriage law system of our country by introducing the legal matrimonial property system of foreign countries and combining the specific conditions of our country.The fourth part is the path analysis of the transformation rule returning to the marriage law of our country, and puts forward the legislative conception of returning the transformation rule of husband and wife's personal property to the marriage law of our country.I hope that the author's research can be helpful to the existing marriage and family problems, and can alert us to carry out more thorough argumentation and discussion before repealing the legal provisions.
