【摘要】：农村留守儿童是我国社会结构发展变化的产物,其监护问题已引起社会普遍关注。由于农村留守儿童父母监护职责的缺失和临时委托监护人自身存在的瑕疵,给留守儿童获得照顾、人身安全、接受教育、自身发展等方面的权力屡屡遭到侵犯埋下了隐患。本文针对该现状,以农村留守儿童监护问题为切入点,由特殊到一般,分析我国现行未成年人监护制度的缺陷,并提出相应的解决对策,即完善未成年人委托监护制度。拟从根本上改善农村留守儿童监护缺失、权益受损害的情况,使未成年人监护制度更加完善、更具实际操作性。实施未成年人委托监护是我国社会经济发展现状、现行未成年人监护制度的必然选择,监护职责的可转移性是委托监护的法理基础。国外立法中关于委托监护的规定,为构建我国的未成年人委托监护制度提供了借鉴。虽然我国现行法律承认了未成年人委托监护,但其规定过于笼统,在实践中难以适用。应该在民事立法的监护部分专门规定未成年人委托监护,制定详细的法律条文,以期未成年人委托监护制度形成体系化的法律制度,切实保障未成年人的合法权益。本文第一部分主要分析未成年人委托监护的性质。第二部分介绍农村留守儿童监护的现状及其成因。第三部分阐明完善未成年人委托监护制度是解决农村留守儿童监护问题的途径之一。第四部分对各国未成年人监护立法作出比较和研究。最后借鉴国外立法,提出我国未成年人委托监护的立法对策。
[Abstract]:Left-behind children in rural areas is the product of the changes in China's social structure development, the monitoring problem has caused widespread concern in the community. Due to the lack of parents of children left in rural areas and temporary guardianship duties entrusted Guardian own existence flaw, give left-behind children access to care, personal safety, accept education, its development rights are violated frequently buried the risk in this paper. Aiming at this situation, in the custody of the children left in rural areas as the starting point, from the general to the particular analysis of the shortcomings of our current system of guardianship of minors, and puts forward corresponding countermeasures, namely improving minors entrusted guardianship system. To fundamentally improve the custody of children left in rural areas lack of rights and interests. The situation, make minors guardianship system more perfect, more practical. The implementation of minors entrusted custody is the status of social economic development in our country, the minor The inevitable choice of people's guardianship system, guardianship transfer is the legal basis of entrusted custody. On entrusted guardianship provisions in foreign legislation, for the construction of the minors entrusted guardianship system provides reference. Although China's current law minors entrusted guardianship, but the provisions are too vague, difficult to apply in practice should be in the custody. Part of civil law special provisions of minors entrusted custody, formulate detailed legal provisions, to entrust minors guardianship system formation of legal system, and effectively protect the legitimate rights and interests of minors. In the first part of this paper mainly analyzes the minors guardianship entrusted property. The second part introduces the current situation and the causes of the custody of children left in rural areas. The third part expounds the perfection of juvenile guardianship system is one of the principal ways to solve the custody of the children left behind in rural areas. The fourth part makes a comparison and Research on the guardianship legislation of the minors in various countries. In the end, we draw on the legislation of foreign countries and put forward the Legislative Countermeasures of the custody of the minors in our country.
