论我国法定夫妻财产制度

【摘要】：法定财产制(statutory regime):“约定财产制”的对称。指男女双方结婚后,按照法律规定,对其财产进行管理和处分的制度。是婚姻当事人于结婚前或结婚后,未以契约方式订立其婚姻关系存续中的财产关系或财产约定无效时,依法律规定当然适用的夫妻财产制。所以有的国家法学理论称之为“补充的夫妻财产制”。我国于2001年4月颁布了修改后的《婚姻法》,从该法第17条、18条、19条的具体规定可以看出,我国现行法对夫妻财产制实行法定财产制和约定财产制双轨制,当事人有财产约定时从约定,无财产契约或约定无效时适用法定财产制。我国目前生产力发展水平较低,人们的收入和财富还十分有限。虽然人们现在主体意识增强,但传统婚姻家庭观念仍是国人受影响最深最直接的东西,特别是在农村,人们的观念更为保守,人们普遍不愿去约定夫妻财产制。这些因素决定了我国的夫妻财产制立法必须要立足于中国国情,体现其独特的民族性和地域性,所以我们认为在现阶段强调法定财产制这一法律原则,并以适当的约定财产制作为补充,既符合我国家庭经济多元化的现实,又符合我国各地区经济发展不平衡以及城市和农村在传统观念、文化素质、经济状况等方面存在巨大差异的现实。在本文中笔者介绍了夫妻财产制度的基本理论及我国现行法定夫妻财产制度所包含的内容,分析了我国现行法定夫妻财产制度还存在的几点主要不足,并针对这些缺陷提出了进一步完善我国法定夫妻财产制度的建议。全文共计约40000字左右,共分三章: 第一章是夫妻财产制度的一般理论。第一节首先明确了夫妻财产制度的概念、性质;第二节介绍了从不同角度对夫妻财产制度所做的分类及其内容;第三节简单介绍了我国夫妻财产制度的历史沿革。这一章从总体上对夫妻财产制度的一般理论进行了介绍。第二章是我国现行法定夫妻财产制内容。第一节介绍了法定夫妻财产制度概念、适用情形及其实施意义;第二、三节分别详细研究了我国现行婚后所得共同
[Abstract]:Legal property system: symmetry of contract property system.A system whereby both men and women marry and administer and dispose of their property in accordance with the law.It is the matrimonial property system which is applied by law when the property relationship or the property agreement in the marriage relationship is invalid before or after marriage.Therefore, some national legal theories call it "supplementary matrimonial property system".In April 2001, China promulgated the revised Marriage Law. From the specific provisions of Article 17, Article 18 and Article 19 of this Law, it can be seen that the current law of our country implements the dual track system of legal property system and agreed property system for husband and wife property system.When the parties have property agreement, the agreement, no property contract or invalid agreement applicable to the statutory property system.Our country productivity development level is low at present, people's income and wealth are still very limited.Although people's subjective consciousness has been strengthened, the traditional concept of marriage and family is still the most directly affected thing, especially in rural areas, people's ideas are more conservative, and people are generally unwilling to agree on the marital property system.These factors determine that the legislation of marital property system in our country must be based on China's national conditions and embody its unique national and regional character. Therefore, we believe that the legal property system should be emphasized as a legal principle at this stage.Supplemented by proper agreed property production, it is not only in line with the reality of diversified family economy in China, but also in line with the imbalance of economic development in various regions of our country, as well as the traditional concepts and cultural qualities of cities and rural areas.Economic conditions and other aspects of the existence of huge differences in the reality.In this paper, the author introduces the basic theory of the matrimonial property system and the contents of the current legal matrimonial property system in China, and analyzes the main deficiencies of the current legal matrimonial property system in China.In view of these defects, some suggestions are put forward to further improve the legal marital property system in China.The total amount of this paper is about 40000 words, which is divided into three chapters:The first chapter is the general theory of husband and wife property system.The first section defines the concept and nature of marital property system; the second section introduces the classification and content of marital property system from different angles; the third section briefly introduces the history of marital property system in China.This chapter introduces the general theory of husband and wife property system.The second chapter is the content of the current legal matrimonial property system in China.The first section introduces the concept of legal marital property system, the applicable situation and its implementation significance.
