论我国夫妻财产制度的立法完善

【摘要】：婚姻家庭是社会的构成基础，一个社会的稳定与和谐必然离不开每个家庭的稳定与和谐。“婚姻家庭法”是研究有关婚姻家庭的法律制度、法律关系和与此相关的法律现象的科学。而夫妻财产制度是“婚姻家庭法”立法的重心之一。中国现行的《婚姻法》中有关夫妻财产制的规定经过几次的修改与补充，已经较为完善，使我国逐渐形成了目前的夫妻财产制度体系，在保护夫妻双方利益、维护交易安全方面起到了积极作用，但是《婚姻法》依旧存在规定过于抽象的问题，尤其是夫妻财产与社会经济等相关因素又紧密相连，随着我国市场经济的繁荣发展，，如何健全法律应对随之出现的一些新问题、新情况，成为我夫妻财产制度建设的重点。本文通过对夫妻财产制度的历史沿革和现状的研读，从法律渊源和现实特点分析我国财产制度缺陷，并试图探究我国夫妻财产制度的完善之路。本文主要分为三个部分：第一部分以夫妻财产制度一般理论出发，进而分析我国夫妻财产制度的立法沿革；第二部分介绍我国夫妻财产制度立法现状及不足；第三部分从体系结构及法律内容方面对我国夫妻财产制度提出完善建议。
[Abstract]:Marriage and family is the foundation of society. The stability and harmony of a society must be inseparable from the stability and harmony of each family.The Marriage and Family Law is a scientific study of the legal system, legal relations and related legal phenomena of marriage and family.The marital property system is one of the focuses of the Marriage and Family Law legislation.After several amendments and additions, the provisions of the current Marriage Law of China concerning the property system of husband and wife have been relatively perfect, which has gradually formed the present system of marital property system in order to protect the interests of both husband and wife.The maintenance of transaction security has played a positive role, but the provisions of the Marriage Law are still too abstract, especially the related factors such as husband and wife property and social economy are closely linked, with the prosperity and development of the market economy in our country,How to perfect the law to deal with some new problems and new situations has become the focal point of the construction of our husband and wife property system.By studying the history and present situation of marital property system, this paper analyzes the defects of our country's property system from the angle of legal origin and realistic characteristics, and attempts to explore the way to perfect our country's marital property system.This paper is divided into three parts: the first part is based on the general theory of the marital property system, and then analyzes the legislative evolution of the marital property system in China, the second part introduces the current situation and deficiencies of the marital property system in China.In the third part, some suggestions are put forward to perfect the marital property system from the aspects of system structure and legal content.
