人身安全保护令的实施困境及其破解机制研究

【摘要】：我国《反家庭暴力法》自2016年3月1日出台至今,人身安全保护令的适用范围扩展明显,,多数被申请人未出现违反情况,对家庭暴力受害人的庇护作用增强明显,制度出台的积极效果初步显现。但是在司法实务中,制度的实施过程仍旧存在不少的挑战和难题。究其成因,是由于法院作为人身安全保护令的执行主体难以承受任务之重以及相关法律规定不具备清晰具体的可操作性。本文就此困境和成因提出了相应的破解机制:多机构通力合作,禁止令由公安机关执行,社区协助监督实施、出台细则增强禁止接触令内容的可操作性以及完善违反保护令的法律后果,增强可操作性。
[Abstract]:Since the promulgation of the Anti-domestic violence Law on March 1, 2016, the scope of application of the personal security protection order has obviously expanded, most of the respondents have not violated the situation, and the role of asylum for the victims of domestic violence has been enhanced obviously. The positive effect of the system appeared initially. However, in the judicial practice, there are still many challenges and difficulties in the implementation of the system. The reason is that the court as the subject of personal security protection can not bear the heavy weight of Ren Wuzhi and the relevant laws and regulations do not have clear and specific maneuverability. This paper puts forward the corresponding solving mechanism for the dilemma and causes: the cooperation of many organizations, the enforcement of the prohibition order by the public security organs, and the assistance of the community to supervise the implementation. The introduction of rules to enhance the operability of the contents of the prohibition order and improve the legal consequences of violation of the protection order, enhance operability.
