解除同居关系后彩礼返还的法律分析

【摘要】：《最高人民法院关于适用〈中华人民共和国婚姻法〉若干问题的解释(二)》第十条对彩礼的返还做了规定。我国现阶段一些地区特别是农村地区基于婚约给付彩礼的现象仍十分普遍,很多人举行了结婚仪式后便开始同居生活,同居关系解除便产生彩礼返还纠纷。司法实务中,对同居关系解除中彩礼返还问题的司法解释并不符合实际情况,难以有效解决纠纷。因此,需要对同居关系中的彩礼返还问题作理论梳理,本文通过实务案例分析现行法律的漏洞所在并提出完善立法的建议。
[Abstract]:The interpretation of the application of the Marriage Law of the people's Republic of China by the Supreme people's Court (2) Article 10 provides for the return of the bride price. At present, the phenomenon of paying bride price based on marriage contract is still very common in some areas of our country, especially in rural area. Many people begin to live together after the wedding ceremony, and the dissolution of cohabitation relationship leads to the dispute of return of bride price. In judicial practice, the judicial interpretation of the return of the bride price in the dissolution of cohabitation is not in line with the actual situation, and it is difficult to resolve the dispute effectively. Therefore, it is necessary to sort out the problem of the return of bride price in the cohabitation relationship. This paper analyzes the loopholes of the current law through practical cases and puts forward some suggestions to perfect the legislation.
