婚姻关系的契约性

【摘要】： 婚姻关系是一个复杂的关系体,它承载着伦理、习俗、国家意志等多重价值诉求,具有多重功能,其调整规范也相应具有多重性,有些权利义务内容可以基于当事人的意思来调整,也有相当一部分权利义务内容须基于伦理的、政策性的取向而确定,须负载社会历史的传统和国家秩序的要求。本文对关于婚姻关系本质的各种学说进行了梳理,并对婚姻关系契约性的客观存在给予了理论说明。在强调婚姻关系的契约本质的同时,并非否认其他属性的共生性存在,惟在婚姻关系具有的多重属性状态下,对其中的契约属性及与之相对应的婚姻关系部分,应自觉运用契约法理和技术加以调整,以实现契约法功能最大化,并以此在婚姻关系领域为私法自治保留空间。本文最后以契约观为视角对我国现行《婚姻法》进行了梳理与审视,并提出了几点立法建议,以期能把婚姻关系调整中的契约法原理的功能发挥到最大,从而对婚姻当事人利益做最好的均衡。
[Abstract]:Marriage relationship is a complex relationship body, which carries many value demands, such as ethics, custom, national will and so on. Some of the contents of rights and obligations can be adjusted based on the intention of the parties, while some of the contents of rights and obligations should be determined on the basis of ethical and policy-oriented orientation, and should be loaded with the social and historical traditions and the requirements of the national order. In this paper, various theories about the nature of marriage relationship are combed, and the objective existence of marriage relationship contract is explained theoretically. While emphasizing the contractual nature of marriage relationship, it is not to deny the symbiotic existence of other attributes, but under the condition of multiple attributes of marriage relationship, the contract attribute and the corresponding marriage relation part are discussed. In order to realize the maximum function of contract law, we should consciously apply the contractual legal theory and technology to adjust it and reserve space for the autonomy of private law in the field of marriage relations. Finally, from the perspective of contract view, this paper combs and examines the present Marriage Law in China, and puts forward some legislative suggestions in order to maximize the function of the principle of contract Law in the adjustment of marriage relations. Thus, the interests of marriage parties to do the best balance.
