论鲁迅婚姻所涉及的法律问题──驳“重婚”及“与人通奸者”说

【摘要】：鲁迅与朱安的婚姻源自封建时代的包办婚姻,而他与许广平的婚姻则建立在"五四"时代个性解放、婚姻自主的基础上,这是一个历史的基本事实;但一些研究者却无视历史,不尊重天赋人权,滥用法律,或以当代《婚姻法》认定鲁迅"重婚",或以"民国法律"诬其为"与人通奸",这种炒作性质的"鲁迅研究"是极其失范、非学术化的,是对现代人权和法制的嘲弄与践踏。
[Abstract]:The marriage of Lu Xun and Zhu An originated from the arranged marriage in the feudal era, and his marriage to Xu Guangping was based on the liberation of the 54 era and the autonomy of the marriage, which was a basic fact of history; however, some researchers ignored the history, disrespected the natural human rights, abused the law, or identified Lu Xun "bigamy" with the contemporary < marriage law >, or With the "law of the Republic of China" as "adultery with people", this hype "Lu Xun study" is extremely anomie and non academic, and is a mockery and trampling of modern human rights and legal system.
