论刑法中的家庭伦理价值

【摘要】：刑法与家庭伦理密切相关,我国有着深厚的伦理刑法传统,亲亲相隐、服制入律、严惩亲属相犯、宽纵亲属复仇、存留养亲或留养承祀等思想对我国当代法治建设仍具指导意义。我国伦理刑法传统的当代价值为:缓解情与法的冲突,实现法与德的融合,促进刑法的现代化。同时,家庭伦理也具有犯罪控制机能。我国特殊的近代化历程和特殊国情导致了当前社会家庭功能的部分缺失,为弥补这一缺陷,在构建社会主义核心价值体系和社会主义法制建设过程中注重家庭伦理,重视家庭功能,让家庭伦理价值融入法治,不失为弥补这一缺陷的良方。家庭伦理价值在刑法中的实现以认可公权力的适度介入为思想基础,以家庭法益作为理论基础。家庭法益是以家庭人身关系为基础的,婚姻家庭制度保障下的各种生活利益,以及婚姻家庭制度本身。家庭伦理在刑法中的运行以家庭法益的刑法机能为基础,家庭法益的刑法机能可以使家庭伦理价值在刑法中的实现建立在现代刑法理论制度框架之上,从而与传统的运行机制区别开来。当前我国刑法对家庭伦理价值重视不足,体现为:对部分侵害家庭法益的犯罪执法不严、处罚不力,对婚姻家庭的保护不平等、层次较低、忽视了人性的利己要求,刑罚适用缺乏回归家庭的考虑。刑法对婚姻家庭的保护,总体思路为:立法应当以家庭伦理价值为核心,司法应当遵循伦理保护原则;具体制度设计方面:第一,对家庭进行整体性考虑,宽容家庭的利己行为;第二,设立家庭成员间见危不救罪;第三,树立家庭权威;第四,缓解家庭矛盾;第五,在量刑中考虑家庭伦理因素;第六,构建以“回归家庭”为目的刑罚制度。
[Abstract]:Criminal law is closely related to family ethics. Our country has a deep tradition of ethical criminal law. The thoughts of keeping relatives and sacrificial rites are still of guiding significance to the construction of contemporary rule of law in our country. The contemporary value of the tradition of ethical criminal law in our country is to alleviate the conflict between emotion and law, to realize the fusion of law and morality, and to promote the modernization of criminal law. At the same time, family ethics also has crime control function. The special modernization process and special national conditions of our country have led to the partial absence of the current social family function. In order to make up for this defect, we should pay attention to the family ethics in the process of constructing the socialist core value system and the socialist legal system. Paying attention to family function and integrating family ethical value into the rule of law is a good way to remedy this defect. The realization of family ethical value in criminal law is based on the moderate intervention of public power and the theoretical basis of family law interest. The interests of family law are based on the personal relationship of the family, the interests of life under the protection of the institution of marriage and family, and the institution of marriage and family itself. The operation of family ethics in criminal law is based on the criminal law function of family law interest, and the criminal law function of family law interest can make the realization of family ethics value in criminal law based on the framework of modern criminal law theory system. So as to distinguish from the traditional operation mechanism. At present, the criminal law of our country pays less attention to the value of family ethics, which is reflected in the following aspects: lax enforcement of laws on some crimes against family law interests, inadequate punishment, unequal protection of marriage and family, lower levels, and neglect of human self-interest requirements. The penalty application lacks the consideration of returning to the family. The general idea of the criminal law on the protection of marriage and family is as follows: the legislation should take the family ethical value as the core, the judicature should follow the ethical protection principle; the specific system design aspect: first, carries on the holistic consideration to the family, Tolerance of family egoism; second, the establishment of family members see danger do not save the crime; third, establish family authority; fourth, alleviate family conflicts; fifthly, consider family ethical factors in sentencing; sixth, The purpose of the penalty system is to return to the family.
