夫妻财产赠与法律问题研究

【摘要】：随着《最高人民法院关于适用中华人民共和国婚姻法若干问题的解释三》的颁布,社会上有关该司法解释的争论一直不断,与以往司法解释相较,有的认为该司法解释的出台对于父母出资购房的真实意图提供了客观评判标准,利于保护婚姻双方及父母的权益。也有的认为该司法解释的出台对在婚姻中处于弱势的一方不公平,尤其是对家庭主妇和农村妇女而言。其中最有争议的是《婚姻法司法解释三》第6条的规定,该条规定的夫妻财产赠与应如何定性?应适用《婚姻法》第19条所规定的夫妻约定财产制还是适用《中华人民共和国合同法》(以下简称《合同法》)有关赠与合同的规定?上述问题无论是在学术界还是在司法实务中均有争议。笔者欲通过对不同学者观点的梳理、评析,理清夫妻财产赠与的特点、一般赠与合同的特点,及两者的异同;夫妻约定财产制的特点,两者的关系,进而明确夫妻财产赠与的法律适用。本文共分为五个部分,第一部分对夫妻财产赠与的基本理论做了阐述。第二部分分析夫妻财产赠与中存在的问题,以案例的方式引述存在的问题,并对有争议的与夫妻财产赠与有关的法条《婚姻法》第19条,《婚姻法司法解释二》第8条进行讨论。第三部分介绍了域外国家及我国台湾和澳门地区对夫妻财产赠与的相关立法,以期从域外立法中找到相关可借鉴的规定。第四部分对目前我国夫妻财产赠与中存在的问题提出了一些浅显的完善建议,第五部分是本论文的小结,简要的概述了本文的研究结论。
[Abstract]:With the promulgation of the interpretation of the Supreme people's Court on some issues concerning the Application of the Marriage Law of the people's Republic of China, there has been a constant debate about the judicial interpretation in the society, compared with the previous judicial interpretation. Some believe that the introduction of the judicial interpretation of parents to pay for the real intention of providing an objective evaluation criteria, conducive to the protection of the rights and interests of both parties to marriage and parents. Others argue that the interpretation is unfair to the disadvantaged in marriage, especially housewives and rural women. The most controversial is the provisions of Article 6 of the Judicial interpretation of the Marriage Law. How should the gift of marital property be qualified in this article? Shall the contract property system stipulated in Article 19 of the Marriage Law or the contract Law of the people's Republic of China (hereinafter referred to as "contract Law") be applicable to the contract of gift? These issues are controversial in both academia and judicial practice. The author wants to sort out the characteristics of husband and wife's property gift, the characteristics of general gift contract, the similarities and differences between the two, the characteristics of husband and wife's agreed property system, and the relationship between them through the analysis and analysis of different scholars' viewpoints. Furthermore, it is clear that the law applicable to the gift of husband and wife's property. This paper is divided into five parts. The first part expounds the basic theory of husband and wife property gift. The second part analyzes the problems existing in the gift of husband and wife's property, quotes the existing problems in the form of case, and discusses the article 19 of the Marriage Law and the Article 8 of the Judicial interpretation of the Marriage Law, which are related to the gift of property of husband and wife. The third part introduces the legislation of overseas countries and Taiwan and Macao in order to find the relevant regulations from the extraterritorial legislation. The fourth part puts forward some simple suggestions on the problems existing in the gift of husband and wife property in our country. The fifth part is the summary of this paper, briefly summarizes the research conclusions of this paper.
