【摘要】：2001年4月28日，九届全国人大常委会第二十一次会议通过了《全国人民代表大会关于修改中华人民共和国婚姻法》的规定，与此同时，修正后的《婚姻法》公布实施。可以说，任何法律制度的变化演进，都是现实与历史两种因素共同作用的结果，就法典本身考察，这次婚姻制度的变迁，表现出明显的时代特征。本文从理论与实践相结合的角度，对《婚姻法》改革的背景及其所修改内容的内部层面所反映的法理、伦理价值展开论述，并在充分认识此次修改只是一个局部性修改的基础上，，对《婚姻法》提出一些补充和完善的建议，以此来说明这部既可以称之为“法律化的道德”，也可以称之为“道德化的法律”的《婚姻法》的价值内涵，以期能对《婚姻法》的进一步完善提供有益的参考和借鉴。
[Abstract]:On April 28, 2001, the 21st session of the Ninth NPC standing Committee adopted the provisions of the National people's Congress on amending the Marriage Law of the people's Republic of China. At the same time, the amended Marriage Law was promulgated and implemented. It can be said that the evolution of any legal system is the result of both reality and history. As far as the code itself is concerned, the change of marriage system shows obvious characteristics of the times. From the angle of combining theory with practice, this paper discusses the background of the reform of the Marriage Law and the legal theory and ethical value reflected in the internal level of the amended content. On the basis of fully understanding that this amendment is only a partial amendment, some suggestions are put forward to supplement and perfect the Marriage Law, so as to illustrate that this amendment can be called "legalized morality". It can also be called the "moralized law" of the value connotation of the Marriage Law, in order to provide a useful reference for the further improvement of the Marriage Law.
