【摘要】：高龄化的社会现实,以及国际人权理念的发展,推动了日本任意监护制度的确立。任意监护制度的最大价值在于强调对本人自我决定权的尊重,其主要框架由两部分组成,一是任意监护合同,二是家庭法院通过选任任意监护监督人所进行的公权力监督。该制度吸纳了“尊重自我决定权”、“正常化”、“活用本人残余能力”等人权理念,试图在最大限度的发挥自我决定权与最小限度的公权力干预之间寻求一种最佳平衡。本文重点从确立的背景、过程、内容、实施现状以及存在的问题等角度对日本任意监护制度进行了研究和探讨,并简要提及了该项制度对于我国立法的启示。本文共分为四个部分,主要内容如下：第一部分是日本任意监护制度确立的背景及过程。该部分主要介绍日本的高龄化以及国际人权理念的发展,并且回顾了日本任意监护制度确立的过程,分析了其立法的模式和产生的影响。第二部分讲述了日本任意监护制度的基本内容。本部分从任意监护的概念以及与法定监护的区别入手,分析了任意监护合同的类型、当事人、内容和效力,并介绍了利用该项制度所必经的几个程序。第三部分是日本任意监护制度的实施现状及存在的问题。本部分首先通过一系列的数据和图表,分析了日本任意监护制度实施的现状,并针对该项制度在施行十余年中所暴露出的几个问题进行了评析。第四部分是日本任意监护制度对我国立法的启示。我国目前也同样面对高龄化的挑战,而我国现行的成年监护制度已经无法适应社会的发展。本文在对日本任意监护制度进行探讨研究的基础上,简要阐述了该项制度对于我国未来成年监护立法的借鉴意义。
[Abstract]:The high age social reality and the development of international human rights concept have promoted the establishment of the Japanese arbitrary guardianship system. The greatest value of any guardianship system is to emphasize the respect for the right of self determination. Its main frame is composed of two parts, one is arbitrary custody contract, and the two is the family court by selecting any guardianship. The system absorbs the idea of human rights, such as "respect for self determination", "normalization", "living with my own residual ability", and tries to find the best balance between the maximum exertion of self determination and the minimum public power intervention. This article emphasizes the background, process, content and implementation of the status quo. From the point of view of existing problems, this paper studies and discusses the arbitrary guardianship system in Japan, and briefly introduces the Enlightenment of this system to China's legislation.
This article is divided into four parts, the main contents are as follows:
The first part is the background and process of the establishment of the Japanese arbitrary guardianship system. This part mainly introduces the age of Japan and the development of the international human rights concept, and reviews the process of establishing the Japanese arbitrary guardianship system, and analyzes the mode and influence of its legislation.
The second part describes the basic contents of the Japanese arbitrary guardianship system. From the concept of arbitrary guardianship and the difference from the legal guardianship, this part analyzes the types, the parties, the content and the effectiveness of the arbitrary custody contract, and introduces several procedures that must be used in the system.
The third part is the current situation and existing problems in the implementation of the Japanese arbitrary guardianship system. This part first analyzes the current situation of the implementation of the Japanese arbitrary guardianship system through a series of data and charts, and evaluates several problems exposed in the past decade.
The fourth part is the Enlightenment of the Japanese arbitrary guardianship system to our country's legislation. At present, China also faces the challenge of the age of age, and the current adult guardianship system in our country is unable to adapt to the development of the society. On the basis of the study of the Japanese arbitrary guardianship system, this paper expounds the system for the future adult of our country. The reference significance of the guardianship legislation.
