农村家庭暴力的法律问题研究

【摘要】：家庭暴力是发生在家庭成员之间的、古今中外常见的、带有普遍性的丑恶现象。它不仅是影响家庭和谐的毒瘤,也是一个全球性的社会问题。为了社会的稳定和和谐发展,遏制家庭暴力已经成为全世界人民的共识。在英美等发达国家已经针对家庭暴力出台了相应的法律法规。在我国,家庭暴力案件每年呈上升发展趋势。2013年3月7日,全国政协委员、全国妇联副主席、书记处书记孟晓驷在政协妇联界讨论时表示：“中国24.7%的女性遭受不同形式的家暴,每年十万家庭因为家暴而解体,全国妇联建议将《反家庭暴力法》列入十二届全国人大常委会立法工作计划项目。”可见家庭暴力在我国非常严重,已经严重影响社会的和谐和稳定。特别是在我国农村地区,家庭暴力已经成为严重的社会问题,虽然我国对家庭暴力的防治规定散见于诸如《宪法》、《婚姻法》、《妇女权益保障法》等法律中,但是我国,尚未出台一部完整的制止和预防家庭暴力的法律,并且在各部门法律体系中,针对制止和预防家庭暴力的法律也不完善,法条抽象、操作不便。针对这种情况,我们认为就反农村家庭暴力提出了相应建议。全文分绪论、正文、结束语三部分。绪论指出了选题的意义和背景,构建下文的文章结构,阐述关于防治农村家庭暴力的相关著作,说明本文的研究方法。第一部分,为农村家庭暴力概述,首先从暴力的基本理论入手,从而理清了家庭暴力、农村家庭暴力等相似概念。再则,在对三者概念进行了比较,总结了农村家庭暴力和认定条件。最后,指出用法律来规制农村家庭暴力是最经济最合理的手段。第二部分,为阐述防治农村家庭暴力存在的具体问题。结合笔者所参与的调查项目,发现了我国现阶段繁殖家庭暴力存在的问题：缺少一部统一的反家庭暴力法、农村婚内强奸日益严重、农村分居现象较为普遍、农村家庭暴力处理难度大。第三部分,为学习和借鉴国外先进经验。主要对英美两个国家的关于防治家庭暴力的制度进行分析,总结出要有效的规制家庭暴力要从制定反家庭暴力法、严格的追责制度、多种的救济主体等各个方面进行同步规制。第四部分,为提出防治农村家庭暴力具体措施。通过学习借鉴国外,最后结合我国农村的实际情况提出：制定一部反家庭暴力法、将婚内强奸罪写入刑法典、建立民事分居制度、建立严格有效的追责制度、构造多部门合作的防治家庭暴力主体、加强农村地区的普法工作共六项措施。希望通过这些建议的提出,能对我国农村反家庭暴力有效的预防和控制、更好的保护受害人的合法权益、推进我国农村的和谐发展起到积极的作用。
[Abstract]:Domestic violence is a common and universal ugliness between home and abroad. It is not only a malignant tumor that affects family harmony, but also a global social problem. For the stability and harmonious development of society, it has become a common understanding of the people all over the world for the development of social stability and harmony. In China, domestic violence has issued corresponding laws and regulations. In the light of the situation, we think that we have put forward corresponding suggestions on anti domestic violence in rural areas.

The second part, in order to explain the specific problems in the prevention and control of rural domestic violence, combined with the investigation project I participated in, found the problems of domestic violence in China at the present stage: the lack of a unified anti domestic violence law, the increasingly serious rape in rural areas, the common phenomenon of rural segregation, the difficulty of rural domestic violence treatment. The third part, in order to learn and learn from foreign advanced experience, mainly analyzes the system of prevention and control of domestic violence in two countries in the United States and Britain, and concludes that the effective regulation of domestic violence should be regulated by the simultaneous regulation of the law of anti domestic violence, the strict accountability system, and many kinds of relief subjects.
The fourth part is to put forward specific measures to prevent domestic violence in rural areas. Through learning from foreign countries and finally combining with the actual situation in China's rural areas, it is proposed to formulate a law against domestic violence, write the crime of rape into the criminal code, establish a system of civil separation, establish a strict and effective system of responsibility for responsibility, and construct a multi department cooperation to prevent domestic violence. There are six measures to strengthen the popularization of law in rural areas.
It is hoped that through these suggestions, it can play an active role in the effective prevention and control of anti domestic violence in rural areas, the better protection of the legitimate rights and interests of the victims and the harmonious development of rural areas in China.
