司法逻辑下的“假离婚”

【摘要】：法院裁判"假离婚"案件的司法智慧是贯彻"区分原则":区分意思表示动机和内容,以确认当事人终止婚姻关系意思的法律效力;区分身份关系与财产关系,以界分该意思表示之于身份关系和财产关系变动的不同法律效力;区分公法关系和私法关系,以规制"假离婚"引发的次生问题。相较于将"假离婚"阐释为"通谋虚假离婚",司法实践秉持的"区分原则"契合了离婚的法律构造、离婚的运行机理以及公法和私法区分的法律逻辑,应该成为解决"假离婚"引发的利益纠葛和法律评价冲突的当然选择。
[Abstract]:The judicial wisdom of the court in deciding the case of "false divorce" is to carry out the "distinction principle": to distinguish the intention, to express motive and content, to confirm the legal effect of the parties' intention to terminate the marriage relationship, to distinguish the identity relationship from the property relationship, In order to regulate the secondary problems caused by "false divorce", the meaning is divided into different legal effects of the change of identity relationship and property relationship, and the relationship between public law and private law is distinguished. Compared with the interpretation of "false divorce" as "conspiracy for false divorce", the principle of distinction upheld in judicial practice accords with the legal structure of divorce, the operational mechanism of divorce and the legal logic of differentiating public law from private law. It should be the natural choice to solve the conflicts of interests and legal evaluation caused by false divorce.
