亲属法价值取向中的人性根基

【摘要】：家庭基于自然人个体结合、繁衍而形成,社会应当注重个体和家庭的双重实现。当代亲属法虽已开始关注家庭整体的价值追求,但缺乏有效落实。从人性论的角度考察,虽然性善论和性恶论都曾作为历史上法制设计的理论根基,但性善论在亲属法中更具有价值,这在中国传统法律中尤为突出,也是实现传统与现代亲属法精神连接的思想和制度资源。在民法典婚姻家庭编的编纂中,需要适当关照人心向善的人性根基,既要关注个体权利,也须注重家庭作为一个整体的权利,促进家庭权利和个体权利的共同实现。
[Abstract]:Family is formed on the basis of individual combination and reproduction of natural persons, and society should pay attention to the double realization of individual and family. Although the contemporary kinship law has begun to pay attention to the value pursuit of the family as a whole, it lacks effective implementation. From the perspective of human nature theory, although both the theory of sexual goodness and the theory of sexual evil have been the theoretical foundation of the legal system design in history, the theory of sexual goodness is more valuable in the law of relatives, which is especially prominent in the traditional Chinese law. It is also the ideological and institutional resource to realize the spiritual connection between tradition and modern kinship law. In the compilation of civil code marriage and family code, it is necessary to give due consideration to the human nature foundation of people's heart and goodness, not only to pay attention to individual rights, but also to pay attention to the rights of the family as a whole and to promote the common realization of family rights and individual rights.
