非婚同居的法律调整模式研究

【摘要】：非婚同居并不是一个新流行的名词,而是一个伴随婚姻长期存在的概念。在我国,非婚同居已不是一个小群体,随着时间的推移和人们观念越来越开放,非婚同居作为一种共同生活模式被越来越多的人接受。随之,一系列问题也被暴露出来,财产纠纷、身份关系不明确、弱者权利的保护等等。本文主要就我国非婚同居所存在的问题,结合对域外法的考虑,提出相关调整方法的建议。本文以非婚同居的法律调整模式研究为题,分别从我国非婚同居法律规制的历史梳理、非婚同居法律调整的域外法考察、我国非婚同居法律问题的制度破解以及事实婚姻及非婚意同居的二元化规制四个部分进行研究分析。第一部分首先对事实婚姻、非婚意同居和非婚同居进行界定并加以区分,再阐述了我国非婚同居法律规范的历史演进以及我国的法律规制所存在的现实问题,从理论和实践两个方面提出我国法律应当对非婚同居现象进行有效调整的必要性,并以此展开下文的论述。第二部分主要阐述了非婚同居法律调整的域外法考察,分别介绍了事实同居模式和登记同居模式,在这两种模式中又分别介绍各国法律给予非婚同居的两种不同的待遇——等同于婚姻的待遇和区别于婚姻的待遇。第三部分结合上文对事实同居模式和登记同居模式的域外法考察之后,论述我国非婚同居法律问题的制度破解,从立法的价值取向和立法模式的选择来建议我国有关非婚同居制度后续立法所应关注的地方。第四部分主要阐述了在后期具体的法律调整中,将事实婚姻和非婚意同居进行二元化的规制,在建立事实婚姻准正制度的同时一并完善非婚意同居的相关立法,从而有效保护非婚同居当事人的利益。
[Abstract]:Non-marriage cohabitation is not a new popular term, but a long-standing concept of marriage. In our country, non-marriage cohabitation is not a small group, and as the time goes on and people's idea is becoming more and more open, the non-marriage cohabitation is accepted by more and more people as a common mode of life. As a result, a series of problems are also exposed, property disputes, unclear identity, protection of the rights of the weak, and so on. This paper mainly discusses the problems existing in non-marriage cohabitation in our country, and puts forward some suggestions on the adjustment methods in combination with the consideration of the extraterritorial laws. This paper, based on the study of the legal adjustment model of non-marriage cohabitation, studies the legal regulation of non-marriage cohabitation from the history of the legal regulation of non-marital cohabitation, and the foreign law of non-marriage cohabitation. The legal problems of non-marriage cohabitation in our country and the dualism regulation of the fact marriage and the non-marital cohabitation are studied and analyzed. The first part defines and distinguishes the fact marriage, the non-marital cohabitation and the non-marriage cohabitation, and expounds the historical evolution of the legal norms of non-marriage cohabitation in our country and the real problems existing in China's legal regulation. From the two aspects of theory and practice, the necessity of effective adjustment of the phenomenon of non-marriage cohabitation should be put forward, and the following discussion will be carried out. The second part mainly expounds the extraterritoriality of the legal adjustment of non-marriage cohabitation, and introduces the fact-cohabiting mode and the registration cohabiting mode, respectively. In these two models, the two different treatment of non-marriage cohabitation, which is equal to the treatment of marriage and the treatment of marriage, are also introduced. The third part, following the investigation of the fact-cohabiting mode and the extraterritoriality of the registration cohabitation mode, discusses the system cracking of the legal problem of non-marriage cohabitation in our country, and proposes the place to pay attention to the follow-up legislation of the non-marital cohabitation system from the choice of the value orientation and the legislative mode of the legislation. The fourth part mainly expounds the regulation of the dualism of the cohabitation of the fact and the non-marriage in the later specific legal adjustment, and perfect the relevant legislation of the non-marital cohabitation together with the establishment of the positive system of the fact marriage, so as to effectively protect the interests of the non-marital cohabiting parties.
