【摘要】： 劳动监察是现代国家根据法律授权对劳动关系进行法律调整与干预的重要手段，这项制度对于劳动法律、法规的贯彻和实施，用人单位和劳动者之间力量关系的衡平，劳动者合法权益的保护，进而促进劳资关系的和谐具有重要意义。现有的劳动监察制度存在着诸多问题：劳动监察立法严重缺乏，法律位阶不高；劳动监察机关的法律权威的缺失；地方政府为保护投资环境，片面追求经济利益，从而忽视劳动者合法权益保护的不当政绩观念；具有行政权和准司法权性质的劳动仲裁与行政权性质的劳动监察的关系，劳动监察和司法权的关系，都需要加以进一步梳理。本文试图从劳动监察的概念、基本原则、功能和内容入手，提出完善我国劳动监察制度的法律对策：提高劳动监察立法的法律位阶，从立法上明确劳动监察机关的功能、管辖范围和设立的重要性；改革现有的行政体制，增强劳动监察机关的权威，减少地方政府的不当干预，，提高执法效率；界定劳动监察和劳动仲裁的管辖范围，厘清两者之间的关系，使其各司其职；改革在劳动争议解决中的劳动仲裁前置程序，完善司法机制。
[Abstract]:Labor supervision is an important means of modern national legal regulation and intervention of labor relations under the legal authority, the system for the implementation of labor laws and regulations, with the balance of power between employers and workers, protect the legitimate rights and interests of workers, and promote harmonious labor relations is of great significance. The existing labor supervision system has many problems: lack of labor supervision legislation, the legal position is not high; the labor supervision organs lack of legal authority; the local government for the protection of the investment environment, one-sided pursuit of economic interests, ignoring the legitimate rights and interests of laborers protection improper government idea; relationship between labor supervision with administrative power and quasi judicial the nature of the right of labor arbitration and administrative power in nature, the relationship between labor supervision and judicial power, need to be further combed.
