【摘要】: 本文从法治理念的角度研究企业的人力资源管理。针对目前企业在人力资源管理法治实际应用中存在的问题,在人力资源管理、国内外劳动立法沿革等现有理论的基础上,结合法治理念的内涵和外延,提出了构建人力资源管理法治理念的途径,对促进人力资源管理的法治化和提高人力资源管理理论水平进行了初步的研究。 主要研究内容如下: 第一、在对相关的国内外研究现状进行分析和评述的基础上,阐明了企业人力资源管理法治理念的研究背景及其研究意义,提出了我国目前人力资源管理的法治化建设中存在的主要问题。 第二、对人力资源管理的基本原理,包括人力资源管理的涵义、内容等进行了梳理和阐述。总结了人力资源管理理论和实践发展的四个阶段,以及国内外劳动立法的沿革过程。 第三、通过对法治与人治、法治与法制、法治与德治之间的关系的辨析,界定了人力资源管理法治理念的基本概念,总结了人力资源管理法治理念的核心内容和价值取向,归纳了人力资源管理法治理念的四个特点。 第四、从本土性、国际性、以及二者的结合等诸方面,分析了法治资源的选取,进而提出人力资源管理法治理念构建的四个途径:立法系统的完善、法制意识的培养、法治程序的规范、法治监督的举措。
[Abstract]:This paper studies the human resource management of enterprises from the perspective of the concept of rule of law. Aiming at the problems existing in the practical application of the rule of law of human resources management in enterprises at present, on the basis of existing theories such as human resources management, the evolution of labor legislation at home and abroad, etc. Combined with the connotation and extension of the concept of rule of law, this paper puts forward the way of constructing the concept of rule of law in human resource management, and makes a preliminary study on promoting the rule of law of human resource management and improving the theoretical level of human resource management. The main contents of the study are as follows:. First, on the basis of analyzing and commenting on the current research situation at home and abroad, this paper expounds the research background and significance of the concept of rule of law in enterprise human resource management. The main problems in the legal construction of human resource management in China are put forward. Secondly, the basic principles of human resource management, including the meaning and content of human resource management, are summarized, and the four stages of the development of human resource management theory and practice are summarized. And domestic and foreign labor legislation evolution process. Thirdly, through the analysis of the relationship between the rule of law and the rule of man, the rule of law and the rule of virtue, this paper defines the basic concepts of the concept of rule of law in human resources management, and summarizes the core content and value orientation of the concept of rule of law in human resources management. This paper summarizes the four characteristics of the concept of rule of law in human resource management. In 4th, this paper analyzes the selection of legal resources from the aspects of nativeness, internationality and combination of them, and then puts forward four ways to construct the concept of human resource management by law: the perfection of legislative system, the cultivation of legal consciousness, etc. The standard of the rule of law procedure, the measure of the rule of law supervision.
