中共苏区政权劳动立法研究

【摘要】: 劳动法是保护劳工、协调劳资关系的法律。中国无产阶级诞生后,即受到了中外资产阶级和本国封建势力的压迫,生活状况十分恶劣。中共产党成立后,积极领导工人运动,并提出了保护劳工的政策。苏区根据地建立后,中共将其政策法制化,由理论鼓吹走向了法制实践。本文梳理了苏维埃时期中共劳动立法的内容,并在此基础上对其立法特点和对根据地的影响进行了探讨。 本文共分五部分: 第一部分:大革命时期中国共产党保护劳动的主张。中共成立后,通过对工人生活、工作状况的了解,初步提出了劳工保护的政策和立法主张。 第二部分:苏区劳动立法的主要内容。这部分内容包括有关废除包工制、反对雇主虐待的规定、有关工作时间的规定、有关工资的规定、有关劳动合同的规定、有关女工保护的规定、有关童工、青工保护的规定,对中共劳动法的内容及发展过程作初步研究。 第三部分:苏区的劳动立法机构与执行机构。这部分包括劳动法的立法机构、劳动法的执行机构建设,从中央和地方两个方面,明晰两种机构的建立发展过程。 第四部分:苏区劳动立法的特点。这部分从两个方面论述中共劳动立法特点,工人积极参与劳动法的执行,中共劳动立法深受共产国际的影响。 第五部分:对苏区劳动立法的评价。中共劳动立法一方面取得了相当大的成就,另一方面由于劳动法中某些方面的规定不适合根据地的具体情况,对根据地建设产生了消极影响。
[Abstract]:The labor law is the protection of labor, coordinating labor relations law. Chinese proletariat is born, namely by Chinese and foreign bourgeois and feudal forces of oppression, the life condition is very bad. After the founding of the Communist Party, active leadership of the workers' movement, and put forward the protection of labor policy. The Soviet base after the establishment of the policy of CPC the legal system, from theory to practice. Advocates of this sort of content of the labour legislation of the Soviet period, and on the basis of the legislation on the characteristics and influence are discussed.
This article is divided into five parts:
The first part: the Communist Party of China's advocating labor protection during the great revolution. After the founding of the Communist Party of China, through the understanding of workers' living and working conditions, the policy and legislative idea of labor protection were tentatively put forward.
The second part: the main content of labour legislation of the Soviet. This part includes relevant abolish contract system, against the employer abuse provisions, the relevant provisions of the work time, the wages of the provisions of the relevant provisions of the labor contract, the relevant provisions, the relevant provisions of labor protection for female workers, young worker protection, make a preliminary study on the content and development process of the the Communist Party of China labor law.
The third part: the labor legislative organizations and executive agencies in the Soviet area. This part includes the legislature of labor law and the implementation of labor law enforcement agencies. It clarifying the establishment and development process of two institutions from two aspects, the central and the local level.
The fourth part: the characteristics of the labor legislation in the Soviet area. This part discusses the characteristics of the labor legislation of the Communist Party of China from two aspects. The workers actively participate in the implementation of the labor law, and the labor legislation of the Communist Party is deeply influenced by the Communist International.
The fifth part: the evaluation of the labor legislation in the Soviet area. On the one hand, the labor legislation of the Communist Party of China has made considerable achievements. On the other hand, because some provisions of the labor law are not suitable for the specific conditions of the base area, it has a negative impact on the construction of the base area.
