【摘要】： 农民工进城务工是我国农村联产承包责任制和城市经济体制改革的必然产物,我国农民工为城市的经济建设做出了巨大的贡献,然而,农民工合法权益受侵害是一个长期以来存在的普遍现象。种种不合理、不公正的现象发生在我国广大的农民工身上,这极大的打击了农民工工作的积极性,不利于我国经济的进一步发展和社会的和谐稳定。农民工的问题引起了社会各界的普遍关注,党中央、国务院也高度重视农民工问题。党的十六大以来,国家对农民工采取了积极引导的政策。2004年、2005年、2006年,连续出台的三个中央1号文件都强调了解决农民工问题的重要性。面对如此重要的现实问题,许多学者积极调研探索,提出了许多有益的保障农民工权益的见解。笔者在广泛收集了有关农民工问题的著作、论文和相关的网络信息的基础上展开写作。本文分四章:第一章为引言,介绍了选题的背景和现实意义、国内外研究状况,以及本文研究的主要内容。在第二章中,概括了我国农民工的概念与身份,分析了农民工的发展壮大以及农民工的作用。在第三章中,分析我国农民工权益难以保障的现状和原因。第四章是本文的重点,针对前一章分析的我国农民工权益难以保障的现状和原因,提出了相应的解决办法。保障农民工权益的首要问题是要保障其劳动报酬权,为此必须建立农民工工资支付保障制度;其次,解决农民工权益受侵害的深层次问题是建立城乡统一的劳动力市场和就业服务体系;再次,完善现有法律法规对农民工权益的保障;最后,针对我国农民工自身的一些特殊情况,制定切实保障我国农民工权益的相关规章制度。
[Abstract]:Migrant workers working in cities are the inevitable outcome of the rural contract responsibility system and the reform of the urban economic system. The migrant workers in our country have made great contributions to the economic construction of the city, however, The violation of the legitimate rights and interests of migrant workers is a common phenomenon that has existed for a long time. All kinds of unreasonable and unfair phenomena have occurred on the vast number of migrant workers in our country, which has greatly hit the enthusiasm of migrant workers' work. The issue of migrant workers has aroused widespread concern from all walks of life. The Party Central Committee and the State Council have also attached great importance to the issue of migrant workers. Since the 16th National Congress of the Party, On 2004, 2005 and 2006, three successive documents of the Central Committee, No. 1, all emphasized the importance of solving the problem of migrant workers. Faced with such important practical problems, many scholars actively investigated and explored. I have put forward a lot of useful opinions on protecting the rights and interests of migrant workers. The author has extensively collected works, papers and related network information about migrant workers. This paper is divided into four chapters: the first chapter is the introduction. This paper introduces the background and practical significance of the topic, the research situation at home and abroad, and the main contents of this paper. In the second chapter, it summarizes the concept and status of migrant workers in China. In the third chapter, the author analyzes the current situation and reasons why the rights and interests of migrant workers are difficult to protect. Chapter 4th is the focus of this paper. In view of the current situation and reasons why the rights and interests of migrant workers are difficult to protect in the previous chapter, the corresponding solutions are put forward. The primary problem of protecting the rights and interests of migrant workers is to protect their right to remuneration. To this end, we must establish a wage payment security system for migrant workers. Secondly, to solve the deep problem of the infringement of migrant workers' rights and interests is to establish a unified labor market and employment service system in urban and rural areas. Thirdly, Improve the existing laws and regulations to protect the rights and interests of migrant workers; finally, in view of some special circumstances of migrant workers in China, formulate relevant rules and regulations to effectively protect the rights and interests of migrant workers in China.
