劳动合同法视角下劳动关系稳定研究

【摘要】: 随着近现代劳动法的发展,构建和谐稳定的劳动关系是社会经济发展的需求与保障。完善劳动合同制度、协调劳动关系、解决劳资纠纷对于当前改革和社会转型具有越来越重要的作用。特别是2008年《劳动合同法》的出台更是促进了劳动法对该理论的研究。但我们也注意到,2007年金融危机暴发以来及新法出台后,在这一社会经济背景下执行新法更显得举步维艰。其中所暴露出来的问题不仅仅是经济不景气造成的,而且还有立法制度上的缺陷。这些问题在某种程度上制约着《劳动合同法》促进劳动关系稳定和社会经济的发展。面对当前就业压力与金融危机的双重困难,在劳动合同变动制度中有必要将劳动合同试用期进行具体区分以缓解劳动者阶层就业难的问题,同时无固定期限劳动合同条款的重新设计有利于维护企业的灵活用工机制。虽然在先前的研究中也有劳动法学者对劳动关系问题的涉猎,但大多只是从某一方面进行研究,并没从新出台的《劳动合同法》角度进行系统和全面的研究。由此,笔者从劳动合同法视角下,围绕着如何保持劳动关系稳定等一系列问题展开了较为系统的讨论,以期为劳动合同法的发展寻求更为切实可行的方向指引。同时也希望以此引起更多劳动法同行对该理论问题的关注。
[Abstract]:With the development of modern labor law, the construction of harmonious and stable labor relations is the demand and guarantee of social and economic development. The resolution of labor disputes is playing an increasingly important role in the current reform and social transformation. In particular, the introduction of the Labor contract Law on 2008 has promoted the study of this theory by the Labor Law. However, we have also noticed that in 2007, the finance industry. Since the outbreak of the crisis and after the enactment of the new law, In this socio-economic context, the implementation of the new law is even more difficult. The problems exposed are not just caused by the economic downturn. There are also defects in the legislative system. To some extent, these problems restrict the stability of labor relations and the social and economic development of the Labor contract Law. In the face of the dual difficulties of the current employment pressure and the financial crisis, In the system of changing labor contract, it is necessary to distinguish the probation period of labor contract in order to alleviate the difficulty of employment of the laborer class. At the same time, the redesign of the terms of labor contracts with no fixed term is conducive to maintaining the flexible employment mechanism of enterprises. Although in previous studies, some labor law scholars have also dabbled in the issue of labor relations, most of them have only carried out research from one aspect. From the perspective of labor contract law, the author discusses a series of problems, such as how to maintain the stability of labor relations and so on, from the perspective of labor contract law. In order to find a more practical direction for the development of labor contract law, and also hope to attract more labor law colleagues to pay attention to this theoretical issue.
