【摘要】:我国是一个人口大国,就业问题的解决对于社会经济的可持续发展以及和谐社会的建设都具有重大的意义。如何通过建立起完善的公共就业服务制度以及相应的法律制度来解决我国的就业问题,是一个重要的课题。论文分析了我国公共就业服务的概况,指出了《就业促进法》的不足之处,探索如何更好的建构我国的公共就业服务法律制度,以便于建立和谐的社会劳动关系。 论文的第一章是绪论部分,从选题背景、问题提出和研究意义阐述了探索和构建我国公共就业服务法律理论体系的重要性。第二章论述了公共就业服务与劳动市场法的关系,对比公共就业服务在澳大利亚、美国、日本对于本国劳动市场法的影响,提出我国公共就业服务在当前的不足之处,并在此基础上,归纳了劳动力市场改革的国内原因,提出在当前形势下公共就业服务的功能应随之发生相应的变化。为了保证公共就业服务的顺利开展,就需要配套的法律明确其保护内容及法律责任的承担。第三章针对这一问题,对公共就业服务法律制度的建构做了论述。分析了我国以《就业促进法》为主的公共就业服务法律制度的现状,重点对公共就业服务法律制度的基础进行了深入研究,通过对就业服务权、公共就业服务的功能作用、政府责任三个问题的理解,提出了完善公共就业服务法律制度的必要性。第四章提出了建立完备的公共就业服务体系以及合理的公共就业服务管理模式,并对我国公共就业服务法律制度的构建给出了建设性意见。 论文通过对我国公共就业服务法律制度的现状和面临的挑战进行分析,研究如何完善我国的公共就业服务法律制度,以便更好的促进就业困难群体的就业,缓解就业压力。作为我国目前保障就业服务主要的适用法,《就业促进法》是构建我国和谐劳动关系的重要法律。但是在这部关系民生的法律中也存在着一些需要完善的地方。一方面需要通过法律的约束,实施积极的就业政策,促进社会经济与就业的协调发展,另外一方面还要采取积极地就业培训机制,形成以劳动者自主就业为基础,以市场调节就业为主导,以政府促进就业为保障的就业机制,创造尽可能好的就业环境,才能提升相对弱势劳动者的就业能力,使其成为劳动力市场的平等主体,形成权利与义务对等的和谐劳动关系。
[Abstract]:China is a populous country, The solution of employment problem is of great significance to the sustainable development of social economy and the construction of harmonious society. How to solve the employment problem of our country by establishing a perfect public employment service system and corresponding legal system, This paper analyzes the general situation of the public employment service in China, points out the shortcomings of the Employment Promotion Law, and explores how to better construct the legal system of the public employment service in our country. In order to facilitate the establishment of harmonious social labor relations. The first chapter of the thesis is the introduction part, from the background of the topic, the question raised and the significance of the research, the paper expounds the importance of exploring and constructing the legal system of the public employment service in our country. The second chapter discusses the relationship between the public employment service and the labor market law. Comparing the influence of public employment service in Australia, America and Japan on the labor market law of our country, this paper puts forward the deficiency of our country's public employment service at present, and on this basis, sums up the domestic reasons of labor market reform. In order to ensure the smooth development of public employment service, the function of public employment service should change accordingly under the current situation. Regarding the need for supporting laws to clarify the content of their protection and the commitment of their legal responsibilities. Chapter III deals with this issue. This paper discusses the construction of the legal system of public employment service, analyzes the present situation of the legal system of public employment service, which is dominated by the Employment Promotion Law, and focuses on the foundation of the legal system of public employment service. Through the understanding of the right of employment service, the function of public employment service and the responsibility of government, The author puts forward the necessity of perfecting the legal system of public employment service. Chapter 4th puts forward the establishment of a complete public employment service system and a reasonable management mode of public employment service. It also gives constructive suggestions on the construction of the legal system of public employment service in China. Through the analysis of the current situation and challenges of the legal system of public employment service in China, this paper studies how to perfect the legal system of public employment service in order to better promote the employment of the group with difficulty in employment. As the main applicable law of protecting employment service in our country at present, the Employment Promotion Law is an important law to construct harmonious labor relations in our country. However, there are some needs in this law which relates to people's livelihood. Perfect place. On the one hand, it needs to be restricted by law, To implement an active employment policy and promote the coordinated development of social economy and employment, on the other hand, we must adopt an active employment training mechanism to form a foundation based on the independent employment of workers and take the market regulation of employment as the leading factor. The employment mechanism, which is guaranteed by the government to promote employment, can improve the employment ability of the relatively weak laborer, make it the equal subject of the labor market, and form the harmonious labor relationship of equal rights and obligations.
