群体性劳动争议的法律援助

【摘要】: 本文从闵行区法律援助工作实践出发,分析了法律援助参与化解群体性劳动争议实践中存在的五方面问题,并提出了相关建议:一是分析了群体性劳动争议案件的受理范围中突出存在的两大问题——经济状况不符合法律援助条件的群体性劳动争议是否受理以及同一群体性劳动争议中不同类别受援人是否区别对待,建议各级法律援助机构要严格依法办事,严把受理关;二是分析了群体性劳动争议法律援助的困难,从受援人和办案程序上提出了解决途径;三是分析了群体性劳动争议法律援助的质量问题是查阅案卷不认真、调查取证图简单、庭审代理不积极,提出了从引入激励机制、建立监督机制、完善管理机制三方面入手予以解决;四是分析了当前群体性劳动争议法律援助的经费与需求间的矛盾,呼吁通过建立群体性劳动争议法律援助专项经费来解决此项矛盾;五是通过分析群体性劳动争议协同预防化解的必要性,提出了协同预防化解的三点设想,即充分发挥基层法律援助工作站的作用、建立健全工作网络、建立健全工作制度。
[Abstract]:Starting from the practice of legal aid in Minhang District, this paper analyzes the five problems existing in the practice of legal aid participation in resolving group labor disputes. Some suggestions are put forward: first, the paper analyzes the two outstanding problems in the accepting scope of group labor dispute cases-whether the economic situation does not meet the conditions of legal aid, whether the group labor dispute is accepted or not and whether the same group is accepted. Whether the different categories of recipients in sexual labor disputes are treated differently, It is suggested that legal aid organizations at all levels should handle affairs according to law strictly and strictly accept and accept the matter. Second, the difficulties of legal aid for group labor disputes are analyzed, and the solutions are put forward in terms of the recipients and the procedure of handling cases. The third is to analyze the problems of the quality of the legal aid for collective labor disputes, such as the lack of careful access to the case file, the simple investigation and evidence collection chart, the lack of active trial agents, the introduction of incentive mechanisms and the establishment of a supervisory mechanism. The fourth is to analyze the contradiction between the funds and the needs of the legal aid for the group labor dispute, and to call for the establishment of the special fund for the legal aid of the group labor dispute to solve the contradiction. Fifthly, by analyzing the necessity of cooperative prevention and resolution of collective labor disputes, three tentative ideas of cooperative prevention and resolution are put forward, that is, to give full play to the role of grass-roots legal aid workstation, to establish and perfect the work network and to establish and perfect the working system.
