无锡市工会组织创新劳动争议处理机制研究

【摘要】:随着我国经济体制改革的深入推进,产业结构调整步伐不断加快,企业用工形式日益呈现复杂化、劳动关系出现多样化态势,劳动者维权意识不断深化,劳资双方的利益诉求出现了日益严重的对立趋势,劳动争议案件逐步进入高发时期。劳动争议案件正以数量大幅增加、种类复杂多样、处理难度加大的形式显现出来,给现行的“一调一裁二审”劳动争议处理机制带来了挑战,劳动争议处理机制的弊端日益显现。 劳动关系反映的是劳方与资方之间的利益分配关系,是一个不断变化、发展的过程。用人单位与劳动者之间的矛盾和冲突就是这个关系自然衍生出来的结果。劳动争议一旦发生,如果得不到及时、有效、合理地解决,劳动者的合法权益就会受到损害。工会是职工利益的代表,维护职工合法权益是工会的基本职责,积极参与劳动争议处理是工会履行职责的重要手段之一,也是《劳动法》、《工会法》、《劳动合同法》、《劳动争议调解仲裁法》等诸多法律赋予工会的法定职能。 目前我国“一调一裁二审”的劳动争议处理机制下,工会在劳动争议处理中积极地发挥了参与协商、调解、参与仲裁和参与诉讼的作用,但是工会在经济、行政等方面缺乏独立的主体地位,参与协商的操作性规范缺失、在调解制度转型中角色定位不清、劳动争议处理相关机制弱化等问题也限制了工会在劳动争议处理中的作用的进一步发挥。 本文以无锡市工会参与劳动争议处理为例,通过对工会现行作用发挥局限性及原因分析,提出重新定位工会角色,建立劳动关系预警机制、完善劳动争议调解处理机制、建立和完善劳动争议联动化解机制、强化劳动争议调解员的能力和水平等设想,探索研究工会在劳动争议处理机制中发挥作用的新途径,不断提升劳动争议案件调解和矛盾纠纷化解的质量和效率,更好服地务经济发展大局。
[Abstract]:With the deepening of the economic system reform in our country, the pace of industrial structure adjustment has been quickened, the employment forms of enterprises have become more and more complicated, the labor relations have been diversified, and the consciousness of protecting the rights of workers has been deepened. The interests demands of both employers and employees have been increasingly opposed to each other, and labor dispute cases have gradually entered a period of high incidence. Labor dispute cases are emerging in the form of a large increase in the number, complexity and diversity of types, and increased difficulty in handling labor disputes. It brings challenges to the current labor dispute handling mechanism of "one tune, one ruling and two trial", and the malpractice of the labor dispute settlement mechanism appears day by day. Labor relations reflect the distribution of interests between workers and employers, and are constantly changing. The process of development. Contradictions and conflicts between employers and workers are the natural result of this relationship. Once labor disputes occur, if they are not resolved in a timely, effective and reasonable manner, The legitimate rights and interests of workers will be damaged. Trade unions are the representatives of workers' interests. Safeguarding the legitimate rights and interests of workers is the basic duty of trade unions. Actively participating in the handling of labor disputes is one of the important means for trade unions to perform their duties. Labor Law, Trade Union Law, Labor contract Law, Labor dispute Mediation and Arbitration Law, etc. At present, under the labor dispute handling mechanism of "one adjustment, one cut and two trials", trade unions actively play the role of participating in consultation, mediation, arbitration and litigation in the handling of labor disputes, but trade unions are in the economy. The administrative and other aspects lack of independent subject status, lack of operational norms to participate in the negotiation, the role of the role in the transformation of the mediation system is unclear, The weakening of labor dispute handling mechanism also limits the trade union's role in labor dispute settlement. This paper takes Wuxi trade union's participation in labor dispute settlement as an example, through analyzing the limitation and reason of trade union's current function, puts forward repositioning trade union's role, establishing labor relation warning mechanism, perfecting labor dispute mediation and handling mechanism. To establish and improve the mechanism of labor dispute resolution, to strengthen the ability and level of labor dispute mediators, and to explore new ways to study the role of trade unions in the mechanism of labor dispute resolution. Constantly improve the quality and efficiency of labor dispute cases mediation and conflict resolution, better serve the overall situation of local economic development.
