论我国外贸法对外贸企业职工就业权的保护

【摘要】:就业问题是保障民生的一个重大问题。我国外贸企业容纳了数量众多的职工但现行外贸法并未给外贸企业职工就业权提供法律保障。2008全球金融危机引起的外贸企业就业风险警示我们,仅仅依靠劳动法、社会保障法和破产法已不能保障外贸企业职工就业权。从外贸法的视角,探讨职工就业权的保护有重要的理论意义和现实意义。 本文从论证外贸法保护职工就业权的必要性入手,强调外贸法对外贸企业职工就业权保护应“以人为本”,从理性宽度和救助深度两维度探讨了外贸法对职工就业权保护的宏观策略和微观程序规则。主要的内容从以下五个部分展开。 第一部分从外贸法保护职工就业权的理论入手,剖析外贸法保护外贸企业职工就业权的基础理论。人权论从职工就业权权利的本质出发,是外贸法保护职工就业权的根本理论;弱势群体保护论和利益相关论从外贸企业职工的地位出发,是外贸法保护职工就业权的本体理论;国家主权论则从国家为职工提供保护的必要性出发,是外贸法保护职工就业权的客体理论。 第二部分从我国当前职工就业权保护的现实背景入手,归纳出职工就业权受侵害或受到威胁的的主要情形来自于国际贸易和贸易保护主义。外贸法调整对象和调整范围的涉外性决定了在外贸经济发展模式变革时期我国外贸法保护外贸企业职工就业权非常必要。 第三部分分析了我国外贸法保护外贸企业职工就业权现状及其存在的问题。我国外贸法没有直接保护外贸企业职工就业权的条款,在立法理念、立法宗旨、执法机构职责、防御机制的健全和法律责任条款的设置等方面都存在缺失。 第四部分和第五部分分别从宏观策略和微观规则的角度探讨我国外贸法保护职工就业权的路径。在总体思路上,一一解决我国外贸法对外贸企业职工就业权保护存在的问题,将国际法合理内容转化到国内外贸法,防止职工就业权受侵害或受到威胁。在微观规则上,主要从程序规则的角度探讨外贸法保护职工就业权的具体措施。我国外贸法应改变行政机关主导的职权主义模式,赋予外贸企业职工主动性,在申请——听证——调查——裁定——救助的给付一套职工就业权保护程序中,积极发挥职工结社权、听证权、异议权、救济权等民主权利的功能。
[Abstract]:Employment is a major issue to protect people's livelihood. Foreign trade enterprises in our country contain a large number of workers, but the current foreign trade law does not provide legal protection for the employment rights of foreign trade enterprises. The foreign trade enterprises caused by the global financial crisis in 2008. Industrial employment risks warn us, Only relying on labor law, social security law and bankruptcy law can not protect the employment right of foreign trade enterprise workers. From the perspective of foreign trade law, it is of great theoretical and practical significance to discuss the protection of workers' employment right. This article starts with the necessity of the foreign trade law to protect the workers' employment right. It is emphasized that the protection of foreign trade law to the employment right of foreign trade enterprise workers should be "people-oriented", and the macro strategy and microcosmic procedure rules of foreign trade law for the protection of workers' employment right are discussed from two dimensions of rational width and depth of aid. The main contents are as follows:. The following five parts are carried out. The first part begins with the theory of the protection of the right to employment of workers in the foreign trade law, and analyzes the basic theory of the protection of the right to employment of the workers in foreign trade enterprises in the foreign trade law, while the theory of human rights starts from the essence of the right to employment of the workers. It is the fundamental theory of foreign trade law to protect workers' right to employment, the theory of protection of vulnerable groups and the theory of interest correlation from the position of workers in foreign trade enterprises, is the ontology theory of foreign trade law to protect workers' right to employment. The theory of state sovereignty, based on the necessity of providing protection for workers by the state, is the object theory of foreign trade law to protect workers' right to employment. The second part starts with the realistic background of the protection of workers' employment right in our country. It is concluded that the main situation that the workers' right to employment has been infringed or threatened comes from international trade and trade protectionism. The object and scope of the adjustment of foreign trade law decide that in the period of transformation of foreign trade economic development model. National foreign trade law protects foreign trade enterprise worker employment right is very necessary. The third part analyzes the current situation and existing problems of foreign trade law to protect the employment right of foreign trade enterprise workers. The foreign trade law does not directly protect the employment right of foreign trade enterprise workers, in the legislation idea, the legislative purpose, the law enforcement agency duty, the third part has analyzed the foreign trade law protection foreign trade enterprise worker employment right present situation and the existence question. The perfection of defense mechanism and the setting of legal liability clause are all deficient. Part 4th and part 5th discuss the ways of protecting the employment rights of workers in China's foreign trade law from the angle of macro strategy and micro rules respectively. On the general thinking, the problems existing in the protection of employees' employment rights in foreign trade enterprises are solved one by one by the foreign trade law of our country. To translate the reasonable content of international law into domestic and foreign trade law to prevent workers' employment rights from being infringed upon or threatened. This paper mainly discusses the concrete measures of the foreign trade law to protect the workers' right to employment from the point of view of procedural rules. The foreign trade law of our country should change the mode of the power doctrine led by the administrative organs, and give the workers and staff of foreign trade enterprises the initiative. In the procedure of applying for, hearing, investigating, ruling and giving assistance to workers and staff members, the democratic rights such as the right of association, the right of hearing, the right of dissent, the right of relief and so on are actively brought into play.
