【摘要】:德国的《联邦年休假法》实施已经有50年,经过多年学术讨论和司法实践的积累,对于年休假请求权的成立、年休假的安排和补偿、年休假工资等问题已经积累了丰富的经验。比如,树立了安排年休假应该尊重雇员意愿的原则,同时又明确了雇主可以拒绝雇员要求的两种例外情形。为了在我国更好地落实《职工带薪年休假条例》,保障职工休息休假的权利,有必要学习借鉴德国法定年休假制度。
