论用人单位经济补偿金的支付条件和支付标准

【摘要】:十八大报告指出,加强社会建设,必须以改善和保障民生为重点。关注和保障劳动者权益,推进劳方权利救济制度的不断完善与创新,不仅对构建和谐的劳资关系意义重大,而且对改善民生、加强社会主义建设也有着深远的影响。2008年颁布的《劳动合同法》在继承原有《劳动法》相关制度的基础之上,做出了许多创造性的突破,经济补偿金制度的完善就是其中一个重要内容。然而,由于我国对经济补偿金的研究起步较晚,在经济补偿金制度的构建上仍有许多不足之处亟待解决。本文拟通过对国外经济补偿金的立法现状进行考察,针对我国经济补偿金的支付条件与支付标准的立法缺陷提出若干完善建议,以期能为未来我国经济补偿金制度的完备提供借鉴。 本文共分为四个部分,第一部分为经济补偿金的概述,首先论述了经济补偿金的概念,其次运用比较分析方法,,对经济补偿金的性质做出了界定。第二部分介绍我国经济补偿金支付条件与支付标准的立法现状,指出了我国经济补偿金制度支付条件与支付标准的立法不足及实践中需待解决的问题。第三部分为域外经济补偿金制度的研究与借鉴,通过对域外经济补偿金制度进行分析研究,寻找其中对完善我国经济补偿金制度有借鉴意义的地方。第四部分是对完善我国经济补偿金制度的若干建议,根据我国经济补偿金制度的立法缺陷,结合我国的司法实践和国外的立法成果与经验,对我国经济补偿金制度的构建,提出了若干完善建议。
[Abstract]:The report of the 18th National Congress of the National people's Congress pointed out that in order to strengthen social construction, we must focus on improving and safeguarding the people's livelihood, pay attention to and protect the rights and interests of workers, and promote the continuous improvement and innovation of the relief system for workers' rights, which is not only of great significance to the construction of harmonious labor relations. The Labor contract Law promulgated in 2008 has made many creative breakthroughs on the basis of inheriting the relevant systems of the original Labor Law. The perfection of the system of economic compensation is one of the important contents. There are still many deficiencies to be solved in the construction of economic compensation system. In view of the legislative defects of the payment conditions and payment standards of economic compensation in China, some suggestions are put forward in order to provide reference for the perfection of the economic compensation system in China in the future. This paper is divided into four parts. The first part is an overview of economic compensation. Firstly, the concept of economic compensation is discussed, and then the comparative analysis method is used. The nature of economic compensation is defined. The second part introduces the current legislative situation of payment conditions and payment standards of economic compensation in China. It points out that the payment conditions and payment standards of the economic compensation system in China are insufficient in legislation and the problems to be solved in practice. The third part is the research and reference of the extraterritorial economic compensation system. Through the analysis and study of the system of economic compensation outside China, the author tries to find out some suggestions on how to perfect the system of economic compensation in our country, the fourth part is about the suggestions of perfecting the system of economic compensation in our country. According to the legislative defects of the economic compensation system in our country, combined with the judicial practice of our country and the legislative achievements and experience of foreign countries, this paper puts forward some suggestions for the construction of the economic compensation system in our country.
