从“压制型”到“治理型”:我国劳动行政执法模式的转型

【摘要】:长期受政府管理模式的支配,我国劳动行政执法形成了行政主义的压制型模式。该模式面临资源短缺、成本高昂、实效性差等诸多危机,无力回应执法实践的诉求。治理型劳动行政执法模式以治理理念为指导,践行多元主义、合作规制、柔性治理等基本思想,能有效克服压制型模式的不足。应立足于治理逻辑,从执法理念的变革、多元协同执法主体体系的再造以及柔性执法方式的建构等方面,推进劳动行政执法模式的转型。
[Abstract]:Under the control of the government management mode, our labor administrative law enforcement has formed the repressive mode of administrationism for a long time.Faced with many crises, such as shortage of resources, high cost and poor effectiveness, the model is unable to respond to the demands of law enforcement practice.The administrative law enforcement mode of governance type is guided by the idea of governance and practices the basic ideas of pluralism cooperation regulation flexible governance and so on which can effectively overcome the deficiency of the repressive mode.Based on the governance logic, the transformation of labor administrative law enforcement mode should be promoted from the aspects of the reform of law enforcement idea, the reconstruction of multi-cooperative law enforcement subject system and the construction of flexible law enforcement mode.
