新法下高校后勤劳动关系的调整研究

【摘要】:高校后勤的使命是为高校的教育和科研工作提供服务。多种原因导致了高校后勤用工形式的多样性,《劳动合同法》的颁布后,高校后勤的劳动关系变得更加复杂,劳动争议也呈上升趋势,高校后勤的管理面临着挑战和变革。对于高校后勤而言,新法的实施是挑战,也是机遇,对深化调整高校后勤劳动关系将会起到巨大的推动作用。 本文分析了《劳动合同法》与原有劳动法相比较出现的变化,如:适用范围的扩大、劳动合同签订的规范、劳动合同内容的调整、无固定期限劳动合同适用的扩大、经济补偿金适用的扩大、限定了违约金条款等等。在此基础上,分析了这些变化对高校后勤管理的影响,提出了规范劳动用工,预防劳动纠纷,建立高校和谐后勤劳动关系的理念。 以清园大学为例,总结了三年来高校后勤应对《劳动合同法》的一些实际做法和具体措施。根据高校后勤目前劳动关系的现状,结合《劳动合同法》的有关规定,重点分析了高校后勤目前管理机制和体制上存在的问题,提出了应对这些的问题的对策和和解决办法。对深化后勤改革、建立科学规范的后勤人力资源管理制度、完善规章制度、用好员工手册、加大民主参与力度,发挥工会的作用等进行了分析和研究,并对构建和谐的高校后勤劳动关系方面做了着重阐述。
[Abstract]:The mission of university logistics is to provide service for university education and scientific research.After the promulgation of the Labor contract Law, the labor relations of university logistics become more complicated, labor disputes are on the rise, and the management of university logistics is facing challenges and changes.For university logistics, the implementation of the new law is a challenge and an opportunity, which will play a great role in deepening the adjustment of the labor relations in university logistics.This paper analyzes the changes in the Labor contract Law compared with the original Labor Law, such as the expansion of the scope of application, the signing of the labor contract, the adjustment of the content of the labor contract, and the extension of the application of the labor contract without a fixed period of time.The expansion of the application of economic compensation limits the provisions of liquidated damages and so on.On this basis, this paper analyzes the influence of these changes on the logistics management of colleges and universities, and puts forward the idea of standardizing labor employment, preventing labor disputes, and establishing harmonious logistic labor relations in colleges and universities.Taking Qingyuan University as an example, this paper sums up some practical practices and concrete measures for the logistics of colleges and universities in the past three years in response to Labor contract Law.According to the present situation of the labor relations in the logistics of colleges and universities, combined with the relevant provisions of the Labor contract Law, this paper emphatically analyzes the problems existing in the management mechanism and system of the logistics in colleges and universities, and puts forward the countermeasures and solutions to these problems.The paper analyzes and studies the deepening of logistics reform, the establishment of a scientific and standardized logistic human resources management system, the improvement of rules and regulations, the use of staff manuals, the strengthening of democratic participation, and the exertion of the role of trade unions.And the construction of harmonious logistics labor relations in colleges and universities to do focus on the elaboration.
