【摘要】:劳动关系是现代经济生活中最基本、也是最重要的社会关系,是现代社会是否和谐的晴雨表、风向标。在社会主义市场经济条件下,构建和谐劳动关系,体现了科学发展观的内在要求,是建设社会主义和谐社会的基础,具有十分重大的现实意义和理论意义。 当前我国正处于经济和社会的转型期,劳动关系变化日趋剧烈,错综复杂,呈现出多元化、契约化、市场化、法制化和矛盾显性化等新特点。在协调劳动关系方面,随着我国《劳动法》、《工会法》、《劳动合同法》等一系列法律法规的相继出台,劳动法律体系不断完善,劳动关系协调机制初步形成。现阶段,我国劳动关系总体上是稳定协调的。但随着改革开放的不断深入,也出现了诸多劳资关系不和谐问题,如劳动关系确立不规范、侵犯职工经济利益问题比较严重、正常工资增长机制尚未建立、侵害职工人身权利现象时有发生、职工政治民主权利落实不到位等。造成这些不和谐现象的原因是多方面的,既有体制和制度方面的原因,也有企业经营者法律意识淡薄等因素;既有法律法规不健全、劳动保障部门依法治理刚性不足等客观原因,也有劳动者自我保护意识缺乏等主观因素。劳动关系突出问题严重影响了劳动关系的和谐稳定,阻滞了我国社会主义和谐社会的建设进程。 在我国特色社会主义市场经济条件下,企业经营管理者与劳动者的具体利益统一于企业的存续与发展,企业经营管理者与劳动者的根本利益统一于社会主义小康社会建设和中华民族伟大复兴事业,是为我国和谐劳动关系构建的基础。我国和谐劳动关系应具备规范有序、公正合理、互利共赢、和谐稳定的特征。现有体制下,构建和谐劳动关系,必须坚持党的领导的原则、坚持依法推进的原则、坚持协商自愿的原则、坚持国家干预的原则和坚持合作双赢的原则。构建和谐劳动关系,要坚持科学发展观、牢固树立以人为本的理念,健全完善劳动法律法规体系,健全完善劳动关系三方协调机制,健全完善平等协商集体合同制度,健全完善民主管理、劳动争议调处预警等机制,充分发挥政府、工会和企业代表组织的作用。总之,构建和谐劳动关系是一项社会系统工程,要从劳动关系生成的市场环境入手,从劳动关系主体的相互关系出发,关注劳动关系产生和发展的每一个环节,及时化解劳动关系矛盾,为构建和谐劳动关系创造条件、寻求支点。 本文综合运用系统分析、定性分析与定量分析相结合、微观分析与宏观分析相结合等多种方法,多角度对和谐劳动关系构建进行了较为系统的研究。本文的创新点:一是以马克思主义科学社会主义理论为指导,对中国特色社会主义市场经济条件下的劳动关系呈现出的特点进行了理论总结。二是从劳动关系矛盾的普遍性和特殊性两个方面分别进行了研究,既注意从市场经济共性入手,寻找劳动关系运行的普遍规律,又从中国特色社会主义制度这一具体国情出发,研究我国劳动关系的特殊性。三是在提出解决劳动关系矛盾的建议对策方面力求系统,更具针对性和可操作性,不囿于传统的研究思路,创造性地提出了在中国特色社会主义条件下企业经营者与劳动者的具体利益统一于企业的存续与发展,根本利益统一于社会主义小康社会建设和中华民族伟大复兴事业,是我国现阶段和谐劳动关系构建基础的观点;鲜明地提出了和谐劳动关系的核心是保持劳资力量均衡的观点;提出了政府干预下的市场自主调节劳动关系的观点;进一步强调了通过组建社区工会等途径增强基层工会组织独立性的观点;进一步强调了通过在党的领导下直选直罢基层工会主席等方式增强基层工会组织代表性的观点,使研究具有更大的参考价值和应用价值。
[Abstract]:Labor relations are the most basic and most important social relations in modern economic life. It is the barometer of whether modern society is harmonious and the vane. Under the conditions of socialist market economy, building a harmonious labor relationship, reflecting the internal requirements of Scientific Outlook on Development, is the foundation of building a socialistic harmonious society, and has a very important reality. Meaning and theoretical significance.
At present, our country is in the period of economic and social transformation. The change of labor relations is becoming more and more intense and complicated. It presents new characteristics, such as diversification, contract, marketization, legalization and contradiction dominance. In coordinating labor relations, a series of laws and regulations, such as labor law, trade union law and labor contract law, have been introduced. The legal system has been perfected and the coordination mechanism of labor relations has been formed initially. At the present stage, the labor relations in China are generally stable and coordinated. However, with the deepening of the reform and opening up, many problems of disharmony between labor and capital have emerged, such as the non standard establishment of labor relations, the serious problems of the economic interests of the workers and the workers, the mechanism of normal wage growth. It has not yet been established, the phenomenon of infringement of the personal rights of the workers and workers has occurred, the implementation of the political and democratic rights of the workers is not in place, and so on. The reasons for these disharmony are many aspects, such as the reasons for the system and the system, the weak legal consciousness of the business operators and so on; the laws and regulations are not sound and the labor security department is governed by law. There are subjective factors such as lack of rigidity and other objective reasons. There are also subjective factors such as lack of self-protection consciousness of workers. The outstanding problem of labor relations has seriously affected the harmony and stability of labor relations and blocked the construction process of socialist harmonious society in our country.
Under the conditions of socialist market economy with Chinese characteristics, the specific interests of the managers and workers are unified in the continuity and development of the enterprises. The fundamental interests of the managers and workers are unified in the construction of the socialist well-off society and the great rejuvenation of the Chinese nation, which is the foundation for the construction of harmonious labor relations in China. The harmonious labor relations in China should have the characteristics of standard and orderly, fair and reasonable, mutual benefit and harmony and stability. Under the existing system, building a harmonious labor relationship, we must adhere to the principle of Party leadership, adhere to the principle of advancing in accordance with the law, adhere to the principle of voluntary consultation, adhere to the principle of state intervention and adhere to the principle of win-win cooperation. We should adhere to the Scientific Outlook on Development, firmly establish the concept of "people-oriented", perfect the system of labor law and regulation, perfect the three party coordination mechanism of labor relations, perfect the system of collective contract, perfect the mechanism of democratic management, labor dispute and early warning, and give full play to the government, trade unions and enterprise representative organizations. In a word, building a harmonious labor relationship is a social system project, starting with the market environment generated by labor relations, starting with the mutual relationship between the main body of labor relations, paying attention to every link of the production and development of labor relations, resolving the contradiction of labor relations in time, creating the conditions for the construction of harmonious labor relations and seeking the fulcrum.
In this paper, systematic analysis, qualitative analysis and quantitative analysis, micro analysis and macro analysis are combined to make a more systematic study on the construction of harmonious labor relations. The innovation point of this paper is: first, the socialist market with Chinese characteristics is guided by the theory of Marx's scientific social principle. The characteristics of the labor relations under the economic conditions are summarized theoretically. Two, the study is carried out separately from the two aspects of the universality and particularity of the labor relations contradiction. It not only pays attention to the common laws of the market economy, but also searches for the general law of the operation of labor relations. It also starts with the specific national conditions of China's special socialist system. The particularity of our country's labor relations. Three is to put forward the system, more pertinence and maneuverability in solving the contradiction of labor relations, not limited to the traditional research ideas, and creatively put forward the existence and development of enterprise operators and workers' specific interests under the conditions of socialism with Chinese characteristics. The fundamental interests are unified in the construction of socialist well-off society and the cause of the great rejuvenation of the Chinese nation. It is the basis for the construction of harmonious labor relations at the present stage in China, and the point of view that the core of the harmonious labor relationship is to maintain the balance of labor and capital is the point of view, and the viewpoint of independent regulation of labor relations under the intervention of the government is put forward. Further emphasizes the view of strengthening the independence of the grass-roots union organizations through the formation of community trade unions, and further emphasizes the view that the representative of the grass-roots union organizations can be strengthened through direct election of the grass roots union chairman under the leadership of the party, so that the research has a greater reference value and applied value.
