广州市外来农民工劳资纠纷的法律研究

【摘要】:我国目前正经历工业化和城镇化的发展历程,农民工的大量涌入在为城市建设和工业带来极大人力资源的同时,农民工的身份认同成为了一个突出的问题。农民工在生活习惯、价值观念乃至社会心理方面都与城市存在着较大的差异,劳动力卖方市场主导下的企业基于交易成本和经济利益的考虑导致劳资矛盾不断,这种劳资纠纷以经济利益为核心,以社会组织为表现形式,以法律制度为外部约束,呈现出了转轨时期的劳资纠纷的多重特点:数量庞大且增长迅速,复杂化且多样化,纠纷的组织性不断加强且利益矛盾越来越明显。从经济学分析矛盾产生的社会动因并从法学的角度进行制度改进和应对的综合研究具有突出的现实意义。 在当代法治社会语境下的劳资纠纷解决机制是包含着利益动机为主要内容的法律机制。企业拥有者更多的自主权和优势地位,这使得劳动者和用人单位通常难以处在同等的地位进行“契约性”的协商,而现有的国家主导型的劳动监察和监督尚难以有效的预防和制止用人企业对于劳动者的侵害行为,广州市作为农民工较为集中的地区,劳资纠纷的解决具有非常强的现实意义,其劳资纠纷的解决多依赖于以“劳动者”为导向的法律援助和保护,存在着协调机制虚化、劳动监察执法效果不佳、仲裁作用难以落到实处、法律保障措施缺位和集体协商机制有待完善等问题,应当从宏观上促进纠纷解决的多元化、注意纠纷解决的公平化和渐进性。并在微观上不断加强农民工法律援助工作、完善多元化的农民工劳资纠纷解决机制、提高劳动监察效果、大力培育促进工会发展和完善保护农民工的法律框架,这样才能真正实现广州市农民工劳资纠纷问题的解决。
[Abstract]:At present, China is experiencing the development of industrialization and urbanization. The influx of migrant workers has brought a great deal of human resources to urban construction and industry at the same time, the identity of migrant workers has become a prominent problem. Migrant workers are different from the city in life habits, values and even social psychology. The consideration of transaction costs and economic interests of enterprises under the guidance of the labor seller market leads to labor conflicts. This kind of labor dispute takes the economic benefit as the core, the social organization as the expression form, the legal system as the external restraint, has presented the many characteristics of the labor dispute in the transition period: the quantity is huge, the growth is fast, the complexity and diversification, The organization of the dispute has been strengthened and the conflict of interests has become more and more obvious. It is of great practical significance to analyze the social causes of contradictions from the angle of economics and to make a comprehensive study of institutional improvement and countermeasures from the angle of law. In the context of the contemporary society of rule of law, the mechanism of labor dispute resolution is a legal mechanism with interest motive as its main content. Business owners have more autonomy and dominance, which makes it difficult for workers and employers to negotiate "contractually" on an equal footing. However, the existing state-led labor supervision and supervision is still difficult to effectively prevent and stop employers from infringing on workers. As a region where migrant workers are concentrated, the settlement of labor disputes in Guangzhou is of great practical significance. The settlement of labor disputes mostly depends on the legal aid and protection directed by "laborer", there is a virtual coordination mechanism, the effect of labor supervision and law enforcement is not good, and the role of arbitration is difficult to carry out. The absence of legal safeguards and the need to improve the collective consultation mechanism should promote the diversification of dispute resolution from the macro perspective and pay attention to the fairness and gradual nature of dispute resolution. And on the micro level, we should strengthen the legal aid work of migrant workers, perfect the diversified labor dispute resolution mechanism of migrant workers, improve the effect of labor supervision, and vigorously foster and promote the development of trade unions and perfect the legal framework for the protection of migrant workers. Only in this way can the problem of labor dispute between migrant workers in Guangzhou be solved.
