1起违反特殊作业人员职业健康监护规定案法律适用探析

【摘要】：目的分析1起特殊作业人员职业健康监护案件存在的违法行为及其法律责任。方法采用基本情况调查和案例分析相结合的方法,依据《中华人民共和国职业病防治法》、《用人单位职业健康监护监督管理办法》和GBZ 188—2014《职业健康监护技术规范》等法律、法规和标准,对用人单位温州市某公交公司驾驶员乙某的家属举报用人单位未安排乙某进行上岗前与在岗期间职业健康检查,安排有职业禁忌证(高血压)的乙某从事禁忌作业的2项举报事项进行监督处理。结果由于浙江省目前尚未审核、批准和设置开展特殊作业人员职业健康检查的医疗卫生机构,导致用人单位在开展职业健康检查工作上存在履行不能情形,故对于用人单位未安排乙某进行上岗前与在岗期间职业健康检查情节,不应根据《中华人民共和国职业病防治法》第七十二条第四款的规定对甲公司予以行政处罚;由于对乙某进行健康检查的医院不具有开展职业机动车驾驶员职业健康检查的资质,无法认定乙某存在职业禁忌。结论涉案用人单位不应承担职业卫生法律责任;浙江省应及早审核、批准和设置一批符合开展特殊作业人员职业健康检查的职业健康检查机构。
[Abstract]:Objective to analyze the illegal behavior and legal liability of a special occupational health care case. Methods according to the Law of the people's Republic of China on the Prevention and Control of Occupational Diseases, the methods of Supervision and Administration of Occupational Health Monitoring of employers and the Technical Specification for Occupational Health Monitoring of GBZ 188-2014, the basic investigation and case analysis were used. The family members of driver B of a public transport company in Wenzhou City, the employer, report that the employer has not arranged for certain employer B to carry out occupational health checks before and during the period of employment. Arrangement of occupational contraindications (hypertension) B engaged in two contraindications to report matters to supervise and deal with. Results due to the fact that Zhejiang Province has not yet examined and approved and set up medical and health institutions to carry out occupational health inspection for special operators, the employers have been unable to carry out the work of occupational health inspection. Therefore, the employer should not give administrative punishment to Company A according to the provisions of the fourth paragraph of Article 72 of the Law of the people's Republic of China on Prevention and Control of Occupational Diseases; Because the hospital that carries on the health examination to B does not have the qualification to carry out the occupational health examination of the professional motor vehicle driver, it is impossible to confirm that there are occupational taboos in the second place. Conclusion the employer involved in the case should not bear the legal responsibility of occupational health, and Zhejiang Province should examine and approve and set up a number of occupational health inspection institutions in accordance with the occupational health examination of special operators.
