我国劳动合同中经济补偿金制度研究

【摘要】: 经济补偿金属于我国劳动合同制度中的一项重要内容,经济补偿金制度特色非常鲜明,与劳动合同解除、终止制度紧密结合在一起。一方面,它作为劳动关系解除或者终止后劳动者权益的附随保障机制,在保护劳动者合法权益方面发挥了积极的作用;另一方面,由于我国关于经济补偿金制度的现行立法及其相关司法解释存在着诸多问题,且理论界对其性质、功能等分歧大,致使在实务运用中出现了许多问题。 本文以经济补偿金的种类和特征为起点,将经济补偿金进行了系统的分类。同时深入分析经济补偿金的性质、功能,并将其与相关概念进行比较,以期彻底并正确地理解经济补偿金的内涵。目前学术界针对经济补偿金的性质存在着四种主导学说,且这四种学说各有千秋也各有不足,可以说经济补偿金的法律性质应当综合多方面的因素考虑,本身具有多重性能。 文章通过与有关国家及地区的比较,对经济补偿金的不同种类进行评析,提出完善建议。主要指出在协商一致解除劳动合同时取消用人单位提出的先行条件,只要达到协商解除合同时的法定底线,劳动者就应得到相应补偿。在《劳动合同法》实施下,工会保护劳动者的作用也难以得到贯彻执行,应参照国外经验,加强工会的集体协商能力,对用人单位违反工会提议时给予一定的法律制裁。对于劳动合同终止时是否适用经济补偿金的问题,本文通过对学界争议开始阐述,肯定了劳动合同终止下支付经济补偿金的积极意义。同时指出劳动合同的短期化与劳动关系的短期化并不具有必然性,在加强社会保障和加大劳动合同改革的基础上,使得劳动合同终止情形下支付经济补偿金制度更为合理。希望经济补偿金制度在特殊用工形式,比如劳务派遣、非全日制用工中也能够适用,以期对经济补偿金这一法律制度日趋走向完善有所助益。 在分析经济补偿金计算标准的月工资时,笔者认为应学习意大利民法典的相关规定,充分考虑到物价上涨等生活因素对工资的影响,这样更有利于保护劳动者的合法权益。另外,在经济补偿金的适用人员方面,特别是对公司管理人员是否适用经济补偿金的规定进行了分析探讨。
[Abstract]:Economic compensation is an important part of the labor contract system in our country. The characteristics of the economic compensation system are very clear, which is closely combined with the termination and termination of the labor contract. On the one hand, it plays an active role in protecting the legitimate rights and interests of workers as the collateral safeguard mechanism of workers' rights and interests after the dissolution or termination of labor relations; on the other hand, There are many problems in the current legislation and related judicial interpretation of the economic compensation system in our country, and there are many problems in the practical application because of the great differences in the nature and function of the theoretical circle. Based on the types and characteristics of economic compensation, the economic compensation is systematically classified in this paper. At the same time, it deeply analyzes the nature and function of economic compensation, and compares it with related concepts in order to understand the connotation of economic compensation thoroughly and correctly. At present, there are four dominant theories on the nature of economic compensation in academic circles, and each of the four theories has its own shortcomings. It can be said that the legal nature of economic compensation should be considered comprehensively in many aspects and has multiple performance. By comparing with other countries and regions, this paper analyzes the different kinds of economic compensation and puts forward some suggestions. It is mainly pointed out that when cancelling the labor contract by consensus, the workers should be compensated accordingly as long as the legal bottom line of the contract is reached when the employer cancels the labor contract by consensus. Under the implementation of "Labor contract Law", it is difficult for trade unions to carry out the function of protecting workers, so it is necessary to strengthen the collective bargaining ability of trade unions by referring to foreign experience, and to impose certain legal sanctions on employers when they violate the proposal of trade unions. As to the question whether economic compensation should be applied to the termination of labor contract, this paper begins to expound the controversy in academic circles and affirms the positive significance of paying economic compensation under the termination of labor contract. At the same time, it is pointed out that the short-term labor contract and the short-term labor relations are not inevitable. On the basis of strengthening social security and strengthening the reform of labor contract, the system of paying economic compensation under the circumstances of termination of labor contract is more reasonable. It is hoped that the system of economic compensation can be applied in special forms of employment, such as labor dispatch and part-time employment, in order to help the legal system of economic compensation to be perfected day by day. In the analysis of the monthly wage of the standard of economic compensation, the author thinks that the relevant provisions of the Italian Civil Code should be studied, and the influence of living factors such as rising prices on wages should be fully taken into account, which is more conducive to the protection of the legitimate rights and interests of workers. In addition, the article analyzes and discusses whether the economic compensation is applicable to the managers of the company.
