广州番禺区农民工劳动权益保护现状的实证研究

【摘要】: 保护农民工的合法权益是转型期中国政府的一项重要职能。本文重点针对农民工在劳动合同、工资支付、劳动时间、劳动强度、福利待遇、社会保险等方面遭受的不公平待遇问题,重点探讨了农村剩余劳动力转移过程中发达工业地区政府应采取何种措施以维护农民工的合法权益,应如何处理好政府、企业和农民工之间的关系,这是当前理论界和社会各界关心的热点问题。 本文在对广州市番禺区某镇230位农民工进行问卷调查和对番禺区L企业进行典型案例调查的基础上发现:(1)农民工的合法劳动权益没有得到有效保障和公平对待,在与地方政府和企业博弈过程中往往处于劣势。(2)企业为了降低生产成本,在保证产品质量的前提下不断地压缩劳动成本,避免承担社会责任。(3)地方政府为了实现经济发展和吸引更多的外来资金,在制度政策的制定和日常行政过程中倾向于与资方结成利益联盟。因此,在出现权益纠纷时,企业往往与地方政府结盟以获得劳动裁决过程中对自己有利的局面,地方政府追求经济发展的执政逻辑鼓励和边缘化农民工,企业不履行法律规定和地方政府职能缺位共同造就了农民工在劳资关系中的弱势和不利地位。 针对广州市番禺区农民工权益保护中存在的突出问题,为了实现劳资双方的和谐共处和社会经济的良性运行,地方政府应该加强各种劳动法律法规的建设,重新定义政府、企业及劳动者在维护农民工劳动权益中的职责,不断加快完善平衡劳资关系的法律法规及加强平衡劳资关系的管制力度,建立起一套在市场主导原则下保护劳动者的合法权益的体系,规范企业的管理,实现政府、企业、农民工的“共赢”格局,增强地方的竞争力,保证我国国民经济的顺利发展和社会安定团结的政治局面。
[Abstract]:Protecting the legitimate rights and interests of migrant workers is an important function of the Chinese government in the transitional period. This paper focuses on the unfair treatment of migrant workers in the aspects of labor contract, wage payment, working hours, labor intensity, welfare treatment, social insurance, etc. This paper mainly discusses what measures should be taken by the governments of developed industrial areas in the process of transferring rural surplus labor to safeguard the legitimate rights and interests of migrant workers, and how to deal with the relationship among the government, enterprises and migrant workers. This is the current theoretical and social circles concerned about hot issues. Based on a questionnaire survey of 230 migrant workers from a town in Panyu District, Guangzhou, and a typical case study of enterprise L in Panyu District, this paper finds that the legitimate labor rights and interests of migrant workers have not been effectively protected and treated fairly. In the process of gaming with local governments and enterprises, enterprises are often at a disadvantage. In order to reduce production costs, enterprises constantly reduce labor costs on the premise of ensuring the quality of products. In order to realize economic development and attract more foreign funds, local governments tend to form interest alliances with management in the process of system policy making and daily administration. Therefore, when the rights and interests disputes arise, the enterprises often form an alliance with the local government in order to obtain the favorable situation in the process of labor adjudication. The local government pursues the ruling logic of economic development to encourage and marginalize the migrant workers. The failure of enterprises to fulfill the laws and regulations and the absence of local government functions jointly create the weak and disadvantageous position of migrant workers in labor relations. In view of the outstanding problems existing in the protection of the rights and interests of migrant workers in Panyu District of Guangzhou, in order to realize the harmonious coexistence between labor and capital and the benign operation of social economy, the local government should strengthen the construction of various labor laws and regulations and redefine the government. The responsibilities of enterprises and workers in safeguarding the labor rights and interests of migrant workers, accelerating the improvement of laws and regulations on balancing labor relations and strengthening the control of balanced labour relations, Establishing a system to protect the legitimate rights and interests of workers under the principle of market leadership, standardizing the management of enterprises, realizing the "win-win" pattern among the government, enterprises, and migrant workers, and enhancing the local competitiveness. To ensure the smooth development of the national economy and social stability and unity of the political situation.
