集体合同制度若干法律问题研究

【摘要】: 我国《劳动合同法》自2008年1月1日起开始实施,其立法宗旨非常明确,就是为了更有效地维护劳动者的合法权益。集体劳动合同(以下简称集体合同)制度是全面贯彻劳动合同法,有效维护劳动者权益的一项重要法律制度。目前国际上通行采用集体合同制度来调整劳动关系、调节劳资纠纷、促进产业和平。在西方市场经济国家,无论是在立法上还是在理论上,集体合同制度均已经成为一项十分成熟的法律制度。从我国实施集体合同制度的情况来看,尽管目前中央和各地方关于集体合同的有关规定不断出台,集体合同的签订比例越来越高,但各方面对集体合同的重要性的认识仍然不足,签订集体合同主要还流于形式,集体合同制度的推进收效甚微,也影响到了广大劳动者权益的有效维护。 国外的经验和大量事实证明,集体合同是增进劳资双方的理解,防范劳资冲突,并在劳资争议出现之后对其予以解决的基本依据。由于劳动争议在我国已经成为一个无法回避的社会问题,其范围、规模正在不断扩大,激烈程度正在不断提高,我国社会政治稳定正面临着劳资冲突的严峻考验,能否妥善有效地解决劳动争议尤其是集体劳动争议,已经成为当前构建和谐社会的重要因素。因此,如何加快建立完善的集体合同法律制度,推进集体合同的广泛适用,显得十分必要和迫切。 笔者希望通过本文的论述,对推进集体合同制度适用和保护劳动者合法权益的关系作一较为深入的研究,同时对于我国现行集体合同制度的不足进行探讨,并提出相应的完善措施,以期更好地维护劳动者的合法权益,进一步推动企业和谐劳动关系与和谐社会的构建。 本文共分引言和正文两大部分,正文部分由四章组成。 第一章论述集体合同制度的基本理论,主要包括集体合同制度的基本概念、内涵与效力以及集体合同制度的功能与作用。 第二章主要分析集体合同制度的发展与沿革情况,通过讲述制度起源、历史发展,对国内外集体合同制度作一对照比较。 第三章分析总结我国集体合同制度在劳动者权益保护方面存在的主要问题和不足。 第四章论述对完善我国集体合同制度的法律思考。主要从加强集体合同立法与研究、进一步推进集体合同的适用、完善集体合同争议解决机制等方面予以阐述。在推进集体合同实施中,当前重点要推进工资集体协商工作。完善集体合同争议解决机制方面,重点要加强劳动争议调解,将矛盾解决在基层。
[Abstract]:The Labor contract Law of our country has been implemented since January 1, 2008, and its legislative aim is very clear, which is to protect the legitimate rights and interests of workers more effectively. Collective labor contract (hereinafter referred to as collective contract) system is an important legal system to carry out labor contract law and protect workers' rights and interests. At present, collective contract system is adopted internationally to adjust labor relations, regulate labor disputes and promote industrial peace. In western market economy countries, the system of collective contract has become a very mature legal system both in legislation and in theory. Judging from the implementation of the collective contract system in our country, although the relevant provisions on collective contracts have been continuously promulgated by the central authorities and various localities, the proportion of collective contracts signed is increasing. However, the importance of collective contract in all aspects is still insufficient, the signing of collective contract is mainly a mere formality, and the promotion of collective contract system has little effect, which also affects the effective maintenance of workers' rights and interests. Foreign experience and a large number of facts have proved that collective contract is the basic basis for enhancing the understanding of labor and management, preventing labor conflicts and resolving them after the emergence of labor disputes. As the labor dispute has become an unavoidable social problem in our country, its scope and scale are constantly expanding, and the degree of intensity is constantly increasing. The social and political stability of our country is facing a severe test of labor and capital conflict. It has become an important factor to construct a harmonious society to solve labor disputes properly and effectively, especially collective labor disputes. Therefore, how to speed up the establishment of a sound legal system of collective contracts and promote the extensive application of collective contracts, it is very necessary and urgent. The author hopes to make a deeper study on the relationship between the promotion of the application of collective contract system and the protection of the legitimate rights and interests of laborers, and at the same time to discuss the shortcomings of the current collective contract system in China. And put forward the corresponding perfect measures, in order to better safeguard the legitimate rights and interests of workers, and further promote the construction of harmonious labor relations and harmonious society. This paper is divided into two parts: introduction and text. The text is composed of four chapters. The first chapter discusses the basic theory of collective contract system, including the basic concept of collective contract system, connotation and effectiveness, as well as the function and function of collective contract system. The second chapter mainly analyzes the development and evolution of the collective contract system, through the description of the origin of the system, historical development, the collective contract system at home and abroad to make a comparative comparison. The third chapter analyzes and summarizes the main problems and shortcomings of the collective contract system in the protection of workers' rights and interests. Chapter four discusses the legal thinking of perfecting the system of collective contract in our country. Mainly from strengthening the collective contract legislation and research, further promote the application of collective contract, improve the collective contract dispute settlement mechanism and so on. In promoting the implementation of collective contracts, the current focus is to promote collective wage negotiations. In order to perfect the dispute settlement mechanism of collective contract, we should strengthen the labor dispute mediation and resolve the contradiction at the grass-roots level.
