社会法范畴和体系探究——以社会法立法为视角

【摘要】：社会法作为我国社会主义法律体系的重要组成部分,是一个独立的法律部门,其范畴包括社会保障关系、社会公益关系及慈善事业关系。目前社会法的理论研究落后于社会法实践,且研究重点局限于劳动法和社会保障法。社会法保护弱者的功能和追求实质公平与正义的主旨,有利于切实保护社会困难群体、弱势群体和特殊群体等的基本生活权益和生存权益,维护社会稳定,促进社会和谐发展。我们应当抓住和谐社会建设带来的机遇,深入研究社会法的有关理论,加快社会法立法步伐,提高社会法立法质量。
[Abstract]:As an important part of China's socialist legal system, social law is an independent legal department, which includes social security relations, social public welfare relations and charitable relations. At present, the theoretical research of social law lags behind the practice of social law, and the research focus is limited to labor law and social security law. The social law protects the function of the weak and the purport of pursuing substantive fairness and justice, which is conducive to the protection of the basic rights and interests of the social disadvantaged groups, the vulnerable groups and the special groups, the maintenance of social stability and the promotion of the harmonious development of the society. We should seize the opportunity brought by the construction of a harmonious society, deeply study the relevant theories of social law, speed up the pace of legislation of social law, and improve the quality of legislation of social law.
