工作环境权的内容及价值

【摘要】:工作环境权是劳动者享有的能够保障其安全和身心健康和谐与愉悦的权利,是对劳动安全卫生保障权的丰富和发展。权利内容包括获得基本劳动安全卫生条件的权利,劳动安全卫生参与决策权、知情权、避险权、拒绝权、培训权、职业灾害补偿权等权利体系。我国《安全生产法》体现了工作环境权的基本理念。工作环境权理念的确立,对于实现以人为本的价值理念,丰富劳动权的内容,倡导社会法理念,具有重要的意义。
[Abstract]:The right to work environment is the right that workers enjoy to ensure their safety, physical and mental health, harmony and pleasure, and the enrichment and development of the right to work safety and health protection. The rights include the right to obtain basic labor safety and health conditions, the right to participate in decision-making, the right to know, the right to avoid risks, the right to refuse, the right to training, the right to compensation for occupational disasters, and so on. The Safety of production Law of our country embodies the basic idea of the right to work environment. The establishment of the concept of working environment right is of great significance to realize the value idea of people-oriented, to enrich the content of labor right and to advocate the idea of social law.
