论劳动纠纷联动联调机制的立法构建

【摘要】:当前,我国处于由计划经济向市场经济转变的关键时期,各种劳动纠纷频发。经济制度的变迁导致劳资双方利益分配不平衡以及价值取向、利益结构的多元化,然而劳动纠纷当事人的利益诉求却缺乏有效应对的沟通机制,最终使得仲裁、法院陷入超负荷状态,以致纠纷拖延、矛盾激化,甚至引发群体性事件,影响社会和经济发展。 在此背景下,本论文分四章尝试对劳动纠纷联动联调机制的立法构建进行研究和探讨。 第一章主要介绍了劳动纠纷联动联调机制的基本理论,其中概述部分主要围绕劳纠纷联动联调机制的概念、特点、法律地位进行阐述,而第二节对我国构建劳动纠纷联动联调机制的必要性和可行性进行了分析。 第二章例举北京、上海和广州三个典型的劳动纠纷联动联调模式来展现我国劳动纠纷联动联调机制在实践中的探索现状,,以及探寻该机制运行过程中存在的各种问题,从而为下文提出分层构建劳动纠纷联动联调机制作铺垫。 第三章主要阐述了美国、德国以及日本三国劳动纠纷调解制度的概况并进行比较分析,从而挖掘其对我国构建劳动纠纷联动联调机制的可借鉴之处。其中美国行政调解模式的代表,日本是三方机制调解模式的代表,德国是法院调解模式的代表。 第四章从企业层面、行政管理层面和仲裁、司法层面三个视角对我国劳动纠纷联动联调的分层构建展开阐述。其中,企业层面侧重从企业里外来设计调解机制,主要探讨层级构建以及参与联动的组织、机构等;行政管理层面则通过村(居)、社区和街(镇)、区县、市四个级别纵向递进设计劳动纠纷联调中心及其衔接问题;仲裁、司法层面则探讨仲裁、诉讼阶段横向联动的问题,包括联动机构、组织,联动形式,联动联调机制运行中需要注意的问题。
[Abstract]:At present, our country is in the key period of transition from planned economy to market economy, all kinds of labor disputes occur frequently. The change of economic system leads to the imbalance of benefit distribution between labor and capital, the diversification of value orientation and interest structure, but the lack of effective communication mechanism to deal with the interests of the parties to labor disputes, which ultimately makes arbitration. The court falls into a state of overload, which results in the delay of disputes, the intensification of contradictions, and even the occurrence of mass events, which affect the development of society and economy. Under this background, this paper attempts to study and discuss the legislative construction of labor dispute linkage mechanism in four chapters. The first chapter mainly introduces the basic theory of the labor dispute linkage mechanism, in which the outline part mainly focuses on the concept, characteristics and legal status of the labor dispute linkage mechanism. The second section analyzes the necessity and feasibility of establishing the linkage mechanism of labor disputes in China. In the second chapter, three typical labor dispute linkage modes, Beijing, Shanghai and Guangzhou, are cited to show the current situation of our country's labor dispute linkage mechanism in practice, as well as the problems existing in the operation of the mechanism. In order to lay the groundwork for the following layer construction labor dispute linkage mechanism. The third chapter mainly expounds the general situation and comparative analysis of the labor dispute mediation system of the United States, Germany and Japan, so as to excavate its reference to the construction of the labor dispute linkage mechanism in our country. Among them, the United States is the representative of the administrative mediation model, Japan is the representative of the tripartite mechanism mediation model, and Germany is the representative of the court mediation model. The fourth chapter expounds the stratification construction of the linkage of labor disputes in China from three perspectives: enterprise level, administrative level, arbitration level and judicial level. Among them, the enterprise level focuses on the design of mediation mechanism from the outside of the enterprise, mainly discusses the construction of hierarchy and participation in the organization, etc.; the administrative level is through the village, community and street (town), district and county, etc. City four levels of vertical progressive design of labor disputes joint center and its connection; arbitration, judicial level is to explore arbitration, litigation stage of horizontal linkage, including the linkage of institutions, organizations, forms of linkage, The problems that need to be paid attention to in the operation of the linkage mechanism.
