用人单位劳动规章制度的法律效力研究

【摘要】:劳动规章制度是一项可以有效规制用人单位行为的重要制度,同时也是劳动与社会保障法领域重要研究的对象。其作为协调用人单位与劳动者关系的重要规则,对维护用人单位内部劳动秩序,规范员工行为,明晰劳资双方义务,推进和谐雇佣关系形成有着重要意义。然而,目前学界对其法律效力研究的文章较少,且针对性不强,笔者基于以上考虑,总结相关学者研究硕果,同时借鉴西方劳动立法相对完善国家的先进立法与实践经验,归纳实践中存在的问题,提出对解决这些问题的合理建议,本文采用比较分析和理论联系实际的方法,共分为四个部分对以上方面进行阐释。第一部分是用人单位劳动规章法律效力的基本理论。首先介绍了用人单位劳动规章制度的概念与特征,然而在厘清相关概念的基础上,介绍与分析关于其法律效力的不同学说。第二部分是国外关于用人单位劳动规章制度法律效力的规定与经验。首先介绍了德国、法国、韩国、日本等国对劳动规章制度效力的法律规定,然后在分析相关国家法律规定的基础上,总结出其可供借鉴的先进经验。第三部分概括了我国法律关于用人单位劳动规章制度在法律效力方面的规定与存在的问题。首先,指出了由于法规依据缺失导致劳动规章制度的法律效力认定困难;然后从制定主体规定不清晰,内容规定宽泛且无审查标准,生效要件可操作性不强,和效力冲突解决过于绝对化方面做出总结。第四部分为完善我国用人单位劳动规章制度法律效力的建议。在第三部分总结出问题的基础上,首先通过建议加强立法,从而为用人单位劳动规章制度的效力认定提供标准;紧接着明确用人单位劳动规章制度能够具有法律效力的内容,在此基础上明确民主协商的所应达到的具体程度,然后通过细化公示方式,提高生效要件可操作性;最后,通过明确效力冲突的解决原则,以维护好劳动者和用人单位双方的合法权益。
[Abstract]:Labor rules and regulations is an important system which can effectively regulate the behavior of employers and is also an important research object in the field of labor and social security law. As an important rule to coordinate the relationship between employers and workers, it is of great significance to maintain the internal labor order of employers, standardize employees' behavior, clarify the obligations of both employers and employees, and promote the formation of harmonious employment relations. However, the current academic research on its legal effect is less, and the pertinence is not strong. Based on the above considerations, the author summarizes the research results of relevant scholars, while learning from the western labor legislation relatively perfect the country's advanced legislation and practical experience. To sum up the existing problems in practice and put forward some reasonable suggestions to solve these problems, this paper adopts the methods of comparative analysis and theory combined with practice, and divides them into four parts to explain the above aspects. The first part is the basic theory of the legal effect of employer's labor regulations. This paper first introduces the concept and characteristics of employer's labor rules and regulations, but on the basis of clarifying relevant concepts, it introduces and analyzes different theories about its legal effect. The second part is about the rule and experience of the employer's labor rules and regulations. This paper first introduces the legal provisions of labor rules and regulations in Germany, France, South Korea and Japan, and then sums up the advanced experience that can be used for reference on the basis of analyzing the relevant national laws and regulations. The third part summarizes the legal effect of the employer's labor rules and regulations and the existing problems. First of all, it points out that it is difficult to determine the legal effect of labor rules and regulations due to the lack of legal basis, and then from the formulation of the main provisions is unclear, the content of the provisions broad and no review standards, the operational requirements are not strong. And effectiveness of conflict resolution is too absolute to make a summary. The fourth part is to perfect our country unit of choose and employ persons labor rules and regulations legal effect suggestion. On the basis of summarizing the problems in the third part, the author first proposes to strengthen the legislation, so as to provide the standard for the determination of the effectiveness of the labor rules and regulations of the employing unit. Then, it is clear that the labor rules and regulations of the employing unit can have legal effect. On this basis, it is clear that the specific level of democratic consultation should be achieved, and then through the refinement of publicity, the operational requirements of the effective elements can be improved. Finally, by clarifying the principle of resolving the conflict of effectiveness, In order to safeguard the legitimate rights and interests of both the laborer and the unit of choose and employ persons.
