劳动法律视角下人力资源管理法律风险探究及对策分析

【摘要】:1994年《中华人民共和国劳动法》颁布,2008年1月1日《中华人民共和国劳动合同法》(以下简称劳动合同法)正式实施,2013年7月1日《劳动合同法修正案》开始施行,这些法律文件构成了我国劳动法律的基本框架。劳动法律的实施,很大程度上提高了劳动者的法律地位,对于改善用工环境、规范企业管理、稳定劳动关系均有很大的推动作用。与此同时,也为企业人力资源管理提出了更高的要求,带来了更大的挑战。在企业实际经营过程中,各项管理疏忽、法律风险仍普遍存在,由此引发的劳动争议层出不穷。人力资源是企业最重要的资源,在最大限度开发并提高人力资源管理效能的同时,如何从劳动法律的角度出发,尽可能识别并规避企业在劳动合同签订前、劳动关系存续过程中、解除劳动合同直至劳动合同解除以后等各个管理环节中存在的法律风险,使得人力资源管理既合理又合法,构建和谐劳动关系,是众多企业面临的一大课题。本文将结合本人企业人力资源管理的工作经历,从劳动法律与人力资源管理的关系入手,总结劳动法律带给企业的影响和目前企业人力资源管理的现状,分析各个管理环节中存在的法律风险,在管理实操经验的基础上,有针对性地提出风险防范的对策,使企业进一步提升人力资源的管理水平。
[Abstract]:The Labor Law of the people's Republic of China was promulgated in 1994, the Labor contract Law of the people's Republic of China (hereinafter referred to as Labor contract Law) came into force on January 1, 2008, and the Amendment to the Labor contract Law came into effect on July 1, 2013. These legal documents constitute the basic framework of our labor law. The implementation of labor law, to a large extent, improves the legal status of workers, and plays a great role in improving the employment environment, standardizing enterprise management and stabilizing labor relations. At the same time, also put forward higher requirements for enterprise human resources management, brought greater challenges. In the actual business process of enterprises, various management negligence, legal risks still exist, resulting in endless labor disputes. Human resource is the most important resource of the enterprise. While developing and improving the efficiency of human resource management to the maximum extent, how to identify and avoid the enterprise as far as possible from the angle of labor law, before the signing of labor contract, In the process of labor relations' existence, the legal risks in various management links, such as rescission of labor contract and termination of labor contract, make human resource management reasonable and legal, and construct harmonious labor relationship. It is a major task facing many enterprises. This article will combine my enterprise human resources management work experience, from the labor law and the human resources management relations, summarizes the labor law to the enterprise influence and the present enterprise human resources management present situation, This paper analyzes the legal risks in various management links and puts forward the countermeasures of risk prevention on the basis of practical management experience so as to further improve the management level of human resources.
