企业内部举报人的劳动法保护研究
[Abstract]:Internal whistleblowers expose the company's common incidents, through reporting the enterprise's illegal and illegal behavior by the relevant departments to punish, to protect the public interest. But at the same time, because the current legal system is not perfect, there is no sufficient legal basis and system guarantee for the protection of internal whistleblowers, which results in frequent incidents of infringing on the interests of internal whistleblowers. The full text is divided into four parts. The first part defines the concept and category of internal whistleblower, analyzes and expounds the legal value and necessity of internal whistleblower protection. In the second part, the author expounds and analyzes the legislative examples of the internal whistleblower protection in the United States, Britain and Korea from three aspects: fully protecting the internal whistleblower's right, reducing the legal risk of the whistleblower and clarifying the compensation standard. When the whistleblower's right to work is violated within the enterprise, it is necessary to deal with it flexibly, to make detailed and reasonable compensation rules in compensation, and to reduce the legal risk of the whistleblower by way of legislation. The third part expounds the current situation of our country's legislation and analyzes the present situation of our country's internal whistleblower labor law protection. At present, there are many problems faced by whistleblowers in our country. The problem of whistleblower information leakage is serious, and the conflict between whistleblower's reporting behavior and workers' loyalty duty makes them bear huge legal risks. This paper makes a detailed analysis on four aspects: the low cost of infringing on the legitimate rights and interests of whistleblowers and the difficulty of protecting rights of whistleblowers in the face of professional retaliation. The fourth part is to our country enterprise internal whistleblower's labor law protection consummation suggestion. It includes establishing whistleblower information secrecy system, clarifying the relationship between whistleblower labor protection and laborer loyalty duty, raising the cost of enterprise infringement, and reducing the difficulty of whistleblower's rights protection. The construction of the internal whistleblower's labor law protection system in our country should deal with the problem of the limit of protection, which can not be overcorrected and lead to the spread of malevolent and high incidence. The reasonable protection of internal whistleblowers in enterprises can promote the good development of internal whistleblower system, benefit the long-term development of enterprises and fully safeguard the public interests of society.
